What did they say? All these cars at Speed seem to be Diablo’s, or older cars. They must be the last of the first Diablo batch that shipped. They were supposed to be building the next batch of 500 Jefe’s a few months ago, but no one has seen or been told there Jefe is in transit. Makes me think they did not start building as scheduled or missed their date to get in the assembly line.

I’d bet allot of those Diablos end up at the Sand Show for sale in the Speed booth next month.

Probably the same thing they would tell you, if you called and asked about yours.

So speed didn’t fulfill their contract of shipping 25 containers and only shipped 10. Is that the basis of the lawsuit?

It has to deal with what was inside 10 containers. Cant read the full docket, but cargo was expecting SXS and most likely 10 containers had parts and not completed cars and it was not declared correctly (no bueno).

So is the shipping company hiding the containers because they did not get payed for that shipment or a previous shipment
My understanding of is you pay upfront to ship containers not after delivery but I could have that wrong.
Or is this just theft, and what about insurance on the containers if it was theft
I know containers fall off the ships and can be covered by insurance

There was a ton of cars at their warehouse in Anaheim when I drove by on Thursday, both inside and outside

All I know is they’re still containers showing up every week maybe not as many as everybody wishes but I heard the lot is full also and Anaheim front and back.

I’d guess there is more to it than what we are reading in the complaint. And the suit is more about the just the process of doing business and not some conspiracy or that Speed is going bankrupt or can’t pay their bills as many would hope.

Orient Express Container is filing a lawsuit to protect their assets and lost revenue. Part of this looks like they are asking the courts to give them the cargo as collateral until the bal due is paid. Seems logical.

Speed’s side might be they have not paid Orient Express as they never received the cargo as it’s been held in customs by CBP. Part of getting your cargo is you have to pay & tax & duties, but if the cargo is held by customs then you can’t pay those fees and any other that are cumulated. And if the CBP won’t release the containers back to he Orient, then drayage charges will start. Typically you get a few days or a week before drayage charges kick in.

Now Speed might be passing the blame to their forwarding agent, if they used one? Or maybe the factory, if they are the ones that created the shipping docs and arranged the containers and carrier. The final consignee (Speed) is typically responsible for all charges unless other terms are agreed upon. It’s possible that the incorrect tariff code (HTS) was used, or if multiple items with different HTS codes were in the container but not properly documented. But it should not take months to resubmit new docs? Its possible that maybe Speed is trying to get whoever is doing their documentation to be liable for the fees and charges if they made the error?

Todd @ Speed commented awhile back about cargo getting held for inspection as trademarks were questioned and mufflers were confiscated and cut open to check if the cats were there and the same spec as what was epa approved. He said each time they were found to be in compliance, but it was costing Speed & the factory money & delays. Could there have been some cars that did not pass and or meet the certification, and that’s these containers?

Also it was said awhile back that a bunch of containers were returned. Could it be that more cars were in transit that were not built and going to meet EPA or or whatever is holding up these cars at Customs, and so they did not unload the containers at the port and returned them to Vietnam?

It will be interesting to see if anything is said about this and what the next step is? Are the fee’s paid once the cargo is released and that’s the end of it? Does Speed file a lawsuit against a forwarding agent if they made the documentation mistake, or if the factory improperly loaded the containers?

And the holding cost is going up daily.

This will be a nightmare to get sorted out.
Everything goes through customs. Now because New Century & Speed have had shipments held, it’s likely more shipments will get flagged for secondary inspection. Which could be just documentation review, or it could mean X-ray or opening the containers for actual inspection.

Also these 25 containers worth of product has been quarantined for a few months now. I believe customs is actually only holding 10 containers, as it said 15 were returned to the carrier but even those 15 containers had not been paid for, thus why they want the goods that were in all 25, that are still at Corona or Riverside as collateral until they are paid. Thats what the suit is an actually about. Other containers have come in since then, so it’s not all containers coming are getting held and quarantined.

I ordered 4 Scania high pressure fuel pumps from England.

First shipper was FEDEX. They sucked and completely botched the shipping/customs.

Reordered using DHL. Smooth as silk.

Had a friend in the parts business that recommended I use DHL.

I deal with containers that come over from Ireland. They are slow but precise and we rarely have an unexpected delay.
I cannot imagine the frustration this is causing both Speed and customers.
Asia is a completely different animal is my understanding.

No. Not even sure I’ll take mine when it comes. So I’m in no hurry at this point. But I deal with international shipments and Customs in the U.S and Asia weekly for the past 20 plus years. I also work with good freight forwarders and brokers who book our Ocean & Air shipment, and clear our shipment through customs. We also do lots of complex drop shipments and consolidations from multiple country’s to HK, then to the U.S. Before Covid had had the opportunity to tour the Long Beach port, and two different bonding warehouses. It’s pretty insane & overwhelming how massive the whole processes is.

So this experience and getting to see the process is how I know how it works. Plus we have had containers stuck in closed areas, and even quarantined by customs, as we mostly are in shared containers and not full loads. So if someone else screwed up the whole container gets held up. Mostly it’s no more than a week or two at most. This is also why it’s important to work with good forwarders as they typically buy the full container and load their customers in it, so they are handing the whole container and know everything inside.

Years ago I spoke to Todd R about their freight and he said they had it worked out. I assumed Hisun was handling it for them as they have bigger buy power due to there volumes. I gave Todd the Forwarder & brokers that the company I work for uses, if he wanted to look into it. But he said they had it handled. I still have no idea if they are doing it inhouse? Having Hisun handle it, or if they are using a forwarder and broker? The way they have botched up shipping in the past makes me think they might be trying to handle it on their own? Maybe they have a US broker?

The shipping company is claiming they are owed money for shipping the containers as contracted to do so. It sounds like some of the the shipping containers were seized by customs and 10 containers remain in custody. Perhaps part of the money owed is rental on the containers that are being held by customs.

I don’t feel that I’m getting F’ed over. Lots has changed since day 1, some good, some bad. Mostly the bad stuff is just because the part in question is not performing as expected, and not because they did some bait & switch or something like that. I’m very confident, Speed did not want to be having issues. For me honestly, it’s not the car that has me questioning if I want to take it. It’s the infrastructure of the business and the lack of dealers. Dealers we were told would be here when cars were delivered, and the overall business plan of the company concerns me.

As far as recourse, we have options. No one is trapped and has to buy the car. A) you can try to sell your position and maybe make a profit as some have. B) Contact Speed and tell them you know longer want the vehicle and ask them to sell it, or do whatever they please, but that you are asking to be refunded.

If you friend is pissed at himself for placing a deposit, then he should call Speed and ask them to sell his spot and refund him his money. The only thing he’s out is time. If he has not been going to the desert or sold his stuff, waiting for the Speed then that’s on him.
