is not legally bound to anyone, because the titles were 'signed over' to a third party . So the actual owner/seller must go after the 'third party' for 'failure of fiduciary duty' .

This would be a different story if the boat were 'stolen', then the property goes back to the original owner/seller .

In cases like this, the new owner has completed a 'true and valid transaction', with the 'third party', and here in lies the problem .

As I understand this from my personal ordeal, the consignment guy having the contractual power over the deal, sells the boat legally to a new owner that pays in full. The transaction gives the boat and title to the new owner. this leaves the payment from buyer in the hands of the consignment guy to pass on to the seller.

In my deal, I got a copy of the buyer's cancelled check and he has my old boat and the title legally transferred to his name. I'm left trying to recover the final $7K owed to me by a broke fuck up who I believe owes others. Can't get any money from him in a civil suit as he put everything he owns in relatives names.:thumbsdown

I imagine there is expensive legal means to tie up a title, but it likely just ads to your loss and you nor the new owner can sell the damned thing until it goes on in court forever.:(

I was talking with a couple people last week, both of which are on here, and the 3 of us could not believe that there are still boats in there and that he is still in town driving around in that big truck.

I have come to the conclusion that Tim (ocm) has to be on some kind of drug or drugs , or he is jus so stupid he can even see the light.

I would think he would jus disappear [emoji107]

I would guess more of those anti-social/sociopathy tendencies are at play here. Its just a giant game of chess, move here, strategy here, string this out, collect this check, just like playing a video game, no morals or emotions or worry for how people feel, perceive you, etc etc. As long as he can literally keep the doors open doing what he is doing, he sees no reason to change anything, just keep the cycle alive, then on to the next.

Not if he handed the signed off title to OCM...if the new owner was handed a boat and title with the seller's signature, the new owner owns the boat. The matter lies between OCM and the seller and the validity of the contract.

If seller didn't read the contract right, it very wall may have been written such that OCM has no legal obligation to pay the guy. Once you hand over a signed title, you hand over everything. Maybe one of the few that did get their $$ can post a copy of the contract

Tim was ordered to turn over his financial records this month in court. The newspaper reported this story that Tim's Lawyer has withdrawn from the case. Once can speculate why, but why bother.. At this point that whole program is just circling the drain.

I feel bad for those that he owes money too, because it would certainly seem the end is near. (Shit has got to be pretty bad, when your own lawyer tells ya he's done)

Hindsight is 20/20.

People kept saying “Everything is fine.”, “It’s just a misunderstanding.” Until all of the incidents stacked up and it started crumbling. It was then obvious what the “haters” were saying all along was true - that the guy is a crook.

Looking back, I’m sure those that stood up for the guy for so long regret it now.

I know from first hand experience - People get picked up in Mexico and "extradited" back ALL THE TIME. Don't believe what you read on the internet. Someone wants to find you, you'll be found in Mexico. Easy enough to work a deal to get said wanted person back across the boarder.

I Dont know about that. But there’s plenty of bounty hunters as well as US LE down there. Snatching someone isn’t difficult. Matter of fact it’s probably easier in Mexico than it is in a non 3rd world country because much of the time you don’t even need to go through the extradition process, just Snatch and go.

I don’t know a lot about carrels but I can’t imagine they would even bother getting involved. Not enough money and I’d imagine they’d want to steer clear of US law enforcement. (Even if they are working with US law enforcement at the higher levels)

I talked to one of the guys he stole a couple hundred thousand from.

He pretty much echoed your sentiments that while it sucks, he had way too much to lose if he had someone go break his legs. In the end a couple hundred wasn’t that big of a deal to him.

There are others though that were selling their boats and it was a huge blow to their household.

Agreed.. In both situations you are not going to throw more "good" money after bad... especially with the risk of the jail time associated with organizing and funding some type of hit.

Other boat may not have had their lights on at the time and the occupants were floating in water, some with no clothes on. One was off duty female DPS officer. I know the guy you are talking about. He used to stay next door to me in the keys. His name is Scotty and while he owns or owned (haven’t talked to him in a few years) one of the larger bars in Belize I don’t believe he was extradited.

Honestly I don’t remember anything legal wise actually happening from that whole deal? (Not saying it did or didn’t, I don’t remember)

He’s was good friends with one legged Timmy (old roadrunner bartender), and Donnie (old fox’s Bartender) etc..

Timmy used to live next door to me as well.

That said ya get your ass to Mexico and the. Fly to a non extradition country was my point. Lol

It's the cartels home turf, so they have local law paid off. Local law is the go between collecting funds and delivering the perp. And if a bounty hunter comes down, he likely has to buy safe passage.

Just guessing

If he shows up and the trail begins, then splits, it does not matter 2 cents. The judge will continue in what is called trial in absentia.

He can get convicted and even sentenced while on the run. The cool thing is IF he splits, the judge will issue a no bail warrant, and if the DA goes for it they will extradite him from any state, and Mexico. We always find fools in Mexico, especially Gringos, they stand out.
