Your facts are wrong. The whole down payment was due before the Show. We gave him the benefit of the doubt he would be paying when he sold his boat. I have all the texts. The last one stating We are waiting for our new house to close. And we can get you a check this weekend. (A month ago) He was told he would get $ when the boat was sold to someone else. On the contract this is stated.

Some of the structure is added after the boat pops from the mold. Depends on the boat

On mine they add glass, balsa, transom to the mold. Then pop it and add the rest.

I paid them when the boat was popped from the mold. They did alot of work after that

My hatch and windshield were dead last.

I guess it depends on what their deal was??

How could they lay up the boat without the bulkheads and stringers not in the mold?

I don't know the story, nor care. Read it, but there's three sides to everything. I've done business with Joe, and he has sent me plenty of business over the years. I've never experienced anything negative with him. I wish the best for both parties, and hope they are able to come to a resolve that is good for both.

Fact remains Peter and I both shared the same experience. I tryed to end this peacfully and would go quiet. Pleaded to just get our money back, asked him to learn from this, and build RPM into something big. I've done no name calling simply shared my expirience. And hope no future customers are ever made to feel this way. I tried to explain to him why we no longer had confidence in his ability to manage an addition 153k. He could have made some attempt to address our concerns; rather he turned to anger, cussing, and name calling. Those are basic facts on top of countless incedents that got us here. I offered to take hull as is as a compramise. We are not dealing with some silly change of mind or funding issue. I had another builder lined up to finish the build and an invoice for motors. As far as money owed; if work was completed that warranted more money I'd drive over and pay tonight. But fact is in the hulls current state with no stringers, bulkheads, tanks, helm or panel inserts, or hatch; it's not worth more than $27500. These are the facts kids and why this went down today.

But it still needs more work but the hard part is done.

And now you want to back out of the deal after the hull is popped. He did his job but you decided to change your mind.

Now granted both of you should have clarified the down payments more clearly before you started so there were no misunderstandings.

But given what we heard I don't think you should get your deposit back until the hull is sold

From a Contractor who has been in a similar deal I mentioned a Mediator. If I had a little free time I would volunteer to help. Fighting is not the answer at this point to come to a resolution.

I was thinking the same thing. From what I read homeboy was running around telling eveyone he was getting a shiny new toy on Facebook and at the boat show. Sounds to me like he couldn't come up with the money and is trying to save face by blaming it on a builders "attitude". What blows my Mind is if your gona buy a nice expensive boat why are You treating the builder like they are trying to steal from you? If you don't trust them to "manage the money"

This. It’s amazing how many people will get on social media and bicker back and forth. Regardless of the boat quality, you can be sure the builder has lost customers due to the arguing online. The same goes for the buyer. I bet a few people will remember his name and will avoid any business relationships.

I have read and saw the post on River Whips. I am on RPM side with this. Money is hard to earn, get and so on. Sounds like he put the cart before the horse and got run over and agree he is trying to save face. In my business I document everything, simple conversations I will throw into a email and send to the other person as a reminder. Provides a written account of conversations. Protects both sides.

I believe just a 19 Daytona hull from Eliminator is more than $20k. I'd guess a 26 carbon hull would be about $60k or so. That's probably 2.5 - 55 gallon barrels of resin and a lot of carbon which is crazy expensive and a pain in the ass to lay. I bet with labor he has more than $27,500 into it.

A judge would side with RPM.

Apparently he wasn't getting a hull # and that what was keeping him from getting the financing going. Turns out it was on the contact the whole time and he didn't even realize it. The guy sounds like a tool. Sounds like he can't bring the bank and is gona end up getting smoked. He keeps saying just give me my money back and then rpm can sell the boat to someone else and make money off of it I don't care. He's trying to eject from the deal. Breaching his contact and has nothing to stand on.

The receipt shows 36500 for the down to get the hull laid. Buyer paid 27500. Rpm is owed 10k that wasn't paid. Now buyer wants his money back after the hull is laid... Someone didn't get the answer they wanted from the bank. Who buys a house and a boat at the same time?
