This thread has made me realize that as much as I value freedom of speech, we should probably add more moderation to the forum. Some of the posts in here are literally “out there”. Some others if it was me I’d change my screen name out of embarrassment..

The part I don’t understand is, a lot of consumers got screwed over, now they’re left having to pick up parts, molds, try to figure out what to do next. They are getting ridiculed for trusting in this company to do them right.

There’s some built emotions I get it, nobody wants to see their buddy lose money. Excuse my ignorance, but did I miss something?

And I don’t think they should be ridiculed.

But there seems to be a stigma that if there’s a legitimate company, that company HAS to make all customers whole. And that’s just not the way the real world works.

Call it theft, bad business, stupidity, too ambitious etc. there are reasons you incorporate a business. #1 reason is to take the liability off of yourself. What seems to be in question is whether the owner failed because he just failed or if he attempted to steal from clients. But why would he make himself personally liable for those debts when he doesn’t have too?

Something that’s a reoccurring theme is that off-road and boating enthusiasts hold company owners personally responsible when the foundation of the business doesn’t work that way. While they may be the face of the company, they are not the first one liable for it.

It doesn’t make anything ok or anyone whole. And honestly I guess it doesn’t matter the reasons for LUXE closing their doors. They’re shut, so those with deposits, half done builds etc need to find a way forward.

If you’re out money you have legal means to try to recoup your loses.

This thread has shown the disconnect between members that’s for sure lol.

Has Luxe declared bankruptcy or does anyone know if that’s in the plans? That would be the only way to try and make creditors more whole.

Either that allows for payment plans and the business to continue or it’s a straight liquidation of everything and disbursement. (Cant remember which is which, CH 7 or CH 11).

Can’t customers be creditors if they show the money they paid in that they didn’t get a product or a refund on?
I believe you need to file suit to become a creditor.

Edit.

But you don’t go BK unless your creditors overweight your cash/income. It’s very possible that they handled the suppliers debts and left the customers hanging. Or the opposite.

If they take deposits with intent to build and go out of business because they misjudged costs, that's seems like just bad business.

If they ask for a progress payment and provide POs for motors, saying it's for your boat and then knowingly install them on another, that seems to take it to another level?

Again, no proof of that here but just an interesting question.

Absolutely. But if we want to muddy the waters further it sounds like the motors are just “material”.

Meaning customers were invoiced for those motors, but since only a dealer can purchase the motors who’s to decide where those motors go?

It’s the wild fucking west as far as I’m concerned. I’m not berating or defending anyone. But damn when you throw down 200k-500k you better know what you’re buying.

Agreed, but in law it seems to come down to whether something was willful. If Fraudulent misrepresentation can be proven (for example a PO sent to customer X and customer X being told those were his motors and he needed to pay his next progress payment, when they were known to the business to be for customer Y) that could be an issue.

Hopefully that isn't the case :)

I would imagine the pontoons were manufactured by someone else and carry their warranty. Not sure how you would get that serviced by another shop though.

I was thinking the same. He has to know and when they are gone who warranties? Unless it's the toons themselves and they are outsourced?

The hulls (deck and below) were made by another toon manufacturer. As stated above and in the comments.

That add is spot on with what would be covered by warranty and what is not.

It really is not that big of a deal if you bought one of these finished ones. The variables are the interior and interior electronics. Yea you might have to re-engineer some stuff if the fold down side door fails, but the rest is just a regular boat with regular parts that most shops can deal with.

The Pontoons and motors are bought with warranties. The fiberglass deck and body was made in-house so no warranty on that. Whoever is rigging the last units I am sure will warranty what ever labor and parts they install. Bad situation for all.

I agree seems cheap for a twin pontoon with the features luxe offers.

There are some videos on this site of them running. Nothing close to the Trifectas or Avalons from what I saw but they weren’t really marketed as a performance toon.

They are built for pleasure, not speed for sure. If you have seen one at the Street fair or checked out one in person, they are huge!

To be a lot wetter. But like you said, they weren’t marketed as a performance toon (I still can’t say that with a straight face 🤦‍♂️) and this one has 300’s. Not exactly shooting for top speeds. But party barge? Aaaaaaaaaall day!!!!

Well the boats posted on FB we’re under 300k and draws were roughly 25-35 k per draw.

Ain't nobody gonna whack anyone over chump change like this! What is the VERY most you are out, $200K? The folks that can afford to pony up $200K can afford to lose $200K and not live under a bridge. People that have those resources aren't going to get tied up in some Lifetime Channel murder for hire bullshit either! This happens over, and over, and over, and over, and over again! Look at OC Tim. The hardest hit he took was a slap from or RD and he fucked over way more people...... Again, people with this amount of cash aren't looking to spend time in prison. You're as much or more drama than the actual storyline here!

I hope this is dealt with in the courts and not the streets. I didn’t say anyone was going to be killed, and certainly not directly by the dude we have a picture of his face.

But we do live in a world where people do get hurt over less than a couple hundred grand sometimes.

Half this site won’t even go to Mexico out of fear.
