So if a person gets ripped off a for lesser sum its the vendors fault.
But if they get ripped off for a larger sum, it’s the customers fault.
So OC Tim’s mistake was to not rob them for higher amounts of money, therefore placing fault on the customer and getting a pass from the RDP mob?

You guys are making no sense at all.
You are actually blaming the customers for being robbed, and ridiculing the victims.
Why?

No I’m blaming them for being dumb. If we are making progress payments why are payments still being made without progress. That’s dumb. And it’s already been said payments were being made at milestones. Well… milestones weren’t reached but payments were made. That’s dumb. I’ve built a new custom boat at cobra. Have you gone through a new build process? I was there weekly watching the build. Go to my build thread it’s all there. Now he wants to insult people and where they live. No I’m not going to play that. He wouldn’t say it to my face because I’d kick the living the shit out of him. Plain and simple. But he can try and sound like a big man here that’s fine

I feel like it is a given that the "vendors" are a piece of shit, people are saying that the customer should know better by now and not get fucked out of the money...

In my uneducated brain. It’s because who gives large 6 figure deposits up front to a startup builder with no collateral then complain about it when it doesn’t pan out.

So, a person that has appeared on a Saturday night, and has only commented to any extent on one thread, is trying to start friction? (And succeeding, I may add)
Settle down girls, it's starting to sound like a Jr. High PE class.

These threads are always the same. Someone pops in to enlighten the group as to what's going on. Someone that is already either hurt by the company or feels they're going to be, finds RDP and goes ballistic. People agree and disagree...the nature of large groups. Eventually, the ones who've only shown up to argue, leave the thread as quickly as they appeared. Been the same pattern the 5 or so years I've been here.

I remember your build just fine.

What makes this situation any different than a customer getting robbed by Tim or the Ultra guy?
The mob called for their heads on sticks, and condemned them to hell.
What is different here?

For the record, I think $400K toons are dumb in general, but that doesn’t diminish the consumers loss.

To say that people were stupid and got what they deserved because they put too much money down is probably the hight of hypocrisy I’ve ever seen on this site, and that’s really saying something.

All OCM Tim’s victims were dumb, don’t you get it? Ultra boats customers, and their landlord - fools for doing business and leasing to him.

Luxe customers that are out their deposit, or worse yet we’re paying for boats they were shown to be at various stages of completion? - We feel for the business owner, and it’s your fault you got ripped off. Come say it to my face.

The reputation of this place certainly precedes itself.

It’s really not. If you give someone a bunch of money and they are supposed to give you something but they give you nothing and you give them more money… that’s fucking dumb. Not even Tim could pull that off. Just like the guys that paid Robbie in full with no car and had to wait forever. That was dumb

Who said all of this was up front? Those boats have been constructed over years.

You are shown a half done boat, you pay to procure engines that are never procured. That is now the victim’s fault?

How about those that had a small deposit to get in line?

Very well could be. May also be for legal reasons? Don't know, not a ballpark I play in...any of these really: New boats, higher end pontoons or legal proceedings

I feel bad for you. I think by getting defensive which you do have the right to isn’t getting you far here though. No one is defending luxe. There is 2 sides to every story and we don’t know them yet. If you’d like to lay it all out from the first interaction we would love to hear it.

They’ve made up their minds.
Until one of the cool kids gets robbed it is going to be all your fault.

They do this all the time.
Eventually the truth will come out and then they’ll call for extreme justice, including the stoning of the perpetrators family.
Until then though the stupid customers are to blame.

Man, I think some of the guys bashing the buyers is crazy. I don’t feel like FB has been defensive at all? He relied on a business and they failed to deliver on their contract. That doesn’t make him (or whoever) dumb, that makes the business they relied on poorly run.

Whether the $50k was everything in their savings or .1% it might change how closely they followed the money, but doesn’t change they paid for a service or product that wasn’t delivered. It may not have been a risk you would take, but doesn’t make it unreasonable for them to expect the product they were promised. Unfortunately they will probably be SOL but that doesn‘t mean they can’t be frustrated.

It‘ll be interesting to see if the boat industry goes to a type of fund control for builds like they do in construction.

I’ve watched Curt from when he left cobra till this bullshit unfolded. Bad deal yes, but he’s not Tim and this is completely different.

I’d have to ask him that I’m not going to assume or exaggerate. According to fb boats still need 100’s of thousands of dollars to be completed after they’ve given 100’s of thousands 😂😂😂 read his first post
To me this is just like speed. And yes I’ve said those people were dumb for a couple years now

There is no need to feel bad for me. What would getting far here look like? This is meaningless for those out money. Getting far here does not get their money back.

How are there 2 sides to a story of a con and failed business? Incomplete boats have been delivered, and people with deposits are still out the money. The shop doors are closed.

What other side is there to hear? You have multiple data point in this thread.

Would you now put a deposit down for a Luxe Toon? How about an Ultra boat? That is the only point of this thread, to get the word out.

That’s ok, we are allowed to disagree.

This very site promoted Luxe boats.
People tend to put value into what this site (and Dave) says.
(I don’t, but that’s another subject😎)
So before going all in about how people were dumb to risk their money, it might be worthwhile remembering who told them it was a good idea?

I’m just going off from what is being said here and Post #76 saying out $100k

If that’s is not the case, then head down and pick up what has been completed so at least you are not out all the money.

Just to be clear, I’m not blaming the buyers, but there also needs to be some due diligence making sure things are progressing as it should.

This is an odd deal you are beating these people up. Someone plopped down some money on a boat they were excited about and that money evaporated and they got nothing. You can think it is foolish they didn't demand a complete boat before paying but that isn't always possible. I was asked to put down a deposit on my boat and did so, knowing the risk. That doesn't mean I wouldn't have been upset if I got nothing for it...

Would you mind sharing what the large deposits got you (was that a complete hull no motor?). And then what the milestones were after that?

Just trying to understand at what point the wheels came off of the operation.

And how many LUXE boats were built using large deposits before they went to “small deposits” to hold a place in line?

Maybe they wouldn’t have had a cash flow issue (once again not the customers fault) if they had continued to require 6 figure deposits.

That is only going to occur if these boats are financed like a house. People paying cash either need an airtight contract or enough liquidity to take what comes. I doubt many builders would let a customer pay a supplier directly, but maybe that is what needs to happen at a new boat builder for everyone to feel safe.

The boat I have now was built from scratch. I have an idea of how it works to build a new boat. There’s a whole thread on it. And that’s my point. A deposit fine, but six figures…come on

It would be a ton of additional overhead, but on boats that are costing as much as a small house, seems like it could be a reasonable way to protect an investment.

Even buying cash, houses still go through Escrow. :)

Mine too :)

You also had the luxury of going and visiting your builder weekly, that's awesome. Some might not have that option. Again, we can argue the follishness or not of trusting someone with your money, but it doesn't change the outcome of a company over extending itself and leaving customers without the full product they paid for. Hopefully it'll get cleared up and everyone will make it out whole.

When I (as someone who is in and out of the RDP community through out the year) see this the same as a "boating community" member that started a new boat company with a revolutionary boat design. It was pretty cool and had a lot of "online" followers. They produced a few boats. I don't know the ins and outs of their financial structure for the company or their deposits. However they completed some boats and had some more inline but the company folded and there was no back lash. Publicly anyway, this situation can be handled in a diplomatic way. The anger is expected but at some point EVERYONE involved is to blame.

The difference there is the boat builder didn't go skulking off. I also think the investors were the only ones out money when that venture failed. The builder still has the unfinished hulls, or at least he did several years ago.

This is what gets me. Larger exchanges of money usually have some pretty good safety checks in place. In construction, there were performance bonds and completion draws, things to keep people in line I guess. Some of these boats may be worth a small house in Cali, but some of them are worth more than my property with a shop, house and acreage here in the sticks. As a small fish, I can't see how any of this takes place at all.

If the initial buyers are listed as "investors", sure, I can see the risk. If a contract is written as a sales contract though, this does suck if the product isn't delivered.
Lawyers will make money, but I fear others may get screwed.

That builder you mention gave every effort possible for success. The last LA Boat show he participated in he displayed his product in the lobby of a hotel near LA Convention Center + open house at that hotel that must have cost him major $$$$.
