Any legitimate sales business is going to MAKE SURE that sales terms and details are clearly nailed down in a sales/consignment agreement. Are you kidding me ?? It took over 2 months since the sale for this OCM guy to figure out what he needed from the seller?? Really? Lol. C'mon guys...

Either all parties involved are incredibly ignorant, or someone was trying to dupe someone else.

And make sure the tires are not bald and have air in them.....:D

You have no idea... Sometimes it's great, and then sometimes you get these people that sit around and talk shit just for the sake of talking shit.

So I will start with the responses in this thread.. All the information has already been laid out, and nothing has changed since these posts were made.

Long story short Tim has asked for a letter stating there are no liens on the boat and trailer. If there is a lien it would not show up on title and could cause problems for the registration of the boat in the future.

The guy 29'Commander is writing the letter tonight and scanning and emailing it to Tim. Upon receipt of the letter Tim will be depositing the entire amount into his bank account tomorrow afternoon.

So long as all that happens then it's a non issue. If something in there doesn't happen then I would expect it will be a shitstorm of biblical proportions and that will be that.. Lol

Well that's where it gets into a bunch of "he said / he said" shit.. Tim claims the guy asked him to cancel the check and do a direct deposit instead (believe it or not it does take time for the banks to stop payment and unwind all that etc.).. The guy claims he didn't even know it was a check.

I say who the fuck cares.. What does it take to resolve the solution? Tim says Letter. Guy says direct deposit.. Seems simple enough to me.

If it doesn't happen, then I guess we'll know who's full of shit, and who isn't.

I don't have time or the energy or give a fuck to bother getting more involved in this situation then I already have.. I'm not going to spend all night typing out every detail of the conversations, and the this and the that.. To have Paul try to poke holes in it. I don't care about any of it.

At the end of the day, The guy said he's writing the letter. Tim said he's paying the dough.. Seems the situation (hopefully) will be resolved by tomorrow. If it isn't, then we'll know.

At the end of the day,,, OCM sold boat for the owner/seller, OCM gets his percentage and pays the rest to his client. I'm thinking that prior to putting deal on paper if I was OCM I would already have all paperwork and know if there was a said lien or not!

It would seem that a lot of people in this thread are not interested in resolution, or even reading how or why something ended up the way it is.. They stand around with their gas cans and their matches wanting to burn someone at the stake.

God help you if you aren't holding a flame thrower right beside them, because obviously if you aren't willing to ruin someones business for no reason then obviously you are on your knees blowing them, and there can be no middle ground, because this is after all the internet.

With all the threads on all the boating forums about OCM and payment delays, why is Tim not busting his ass to keep this shit from coming up. Maybe he is, but it is not showing!

You reputation is all you got in business and if I was Tim I would be doing everything I could to keep shit like this from appearing.

As I understand it, Tim has made some major changes in the way he processes these transactions after the last thread that was on here. Unfortunately this particular transaction happened before those changes were implemented. (According to Tim)

Did I miss who still had possession of said article in question?

In a perfect world that's how I would think it would work. In the boat broker world that's not how it works. According to the contracts, they sell the boat and then have 30 days to pay off the original owner. I am not a boat broker or an expert in the field. I don't know if that's normal or not, or what is or isn't an appropriate time period. I do know no matter who you go through there is some time period where someone else will in fact have the boat, and using it, and the old owner will be waiting to get paid.

Dave says it's ok so it's ok. Never mind facts.

A bote broker sold a boat that was on consignment. The broker wrote a bad check to the seller. Two months later and the seller still has no money.

Now some bullshit paperwork excuse is being brought up.

Well to tell you the truth Brian I have zero desire to be involved in this shit.. There was a time way back in the day where I used to get involved and try to help both parties to reach a resolution. After 10+ years of running forums that time has passed, and now I try to avoid it when at all possible. I'd like you to read the following words carefully though.

When some boat manufacturer has a customer wad up a boat.. They don't call "the internet" and try to make that go away. They call me. (Believe it or not, sometimes it doesn't even matter if it's on RDP or not!! They still fucking call me and say "FIX IT.")

When some customer gets into a dispute with a boating vendor and they post it.. It isn't posted on "the internet." It's posted on "RiverDaves<-------- see that part? Place" Which then unfortunately puts me in a position where I can delete said content, and listen to a bunch of shit stirrers like yourself 460 and Waffles (in this particular thread) tell me how I must be blowing the vendor because I deleted it. Or how the vendor must be fucked because some guy posted something. etc.. At the end of the day either the Vendor will in fact call me and say "Fix That" or the customer will get in touch with me and expect some resolution, or a reason why I'm supposedly "not taking their side" and warning other members etc..

As said for the tenth time now. I'm not taking anybodies side, I rarely do unless it's fairly obvious of what's going on. Unfortunately though to be in my position there's no correct move, there's just varying degrees of bad. Delete it? Protecting the Vendor, and screwing the member (and there by the membership with it).

If you don't delete it then you have a bunch of guys like yourselves that fall somewhere in between Internet Dick Tracy's and Jerry Springer Guests.

In my experience once something like this is posted to the internet, it is best to try and just get it resolved, and move on with your life.

I asked a simple question on PB, not mentioning names or even pointing at a problem with a vendor, and this asshole chimed in an escalated things. Next I know, King Creole, RD, and some dipshit claiming to be this assholes attorney are calling me. I had PMs from other members with similar experiences that I conveyed to KC and RD, and sure enough, now he is a sponsor. Right and wrong doesn't matter. This is a business and business follows money.

If I was a business, I'd like to think that I'd take the truth over money because morals, but morals don't put food on the table...., but If I'd had drinks and lunch with the money, and I'd only met the truth on the interweb, I can't say which side I'd join.

I wish I could say I remember that, but I don't.. and I'm not even sure what forum sponsor you are talking about. As said earlier, years back I used to get way more involved with bullshit like this, then I ever will do now. I'm kinda passed that whole deal, and just do whatever it takes to get it resolved and broom the situation and move on with life.

In full disclosure of some facts here. OCM / Tim is not an advertiser here, nor has he been in years. That being said I did shoot him a text this morning that said he really needs to fix his PR out on the internet, and you are correct sir.. If I end up handling that for him I will absolutely charge the shit out of him for it because I believe it to be a tall order. To keep with transparency, yes I already have a plan that is ethical, and honest, and transparent to fix that PR problem, and could do it in 8 weeks or less.

Well, again people remember a thread and a negative.. The fact is that last fiasco that happened online FOR THE THIRD TIME had a lot more to do with the owner of the boat not wanting to pay taxes on the sale, then it actually had to do with OCM. The owner would not give the titles to the boat, and demanded payment. When Tim received the titles the owner was paid the same day through an attorney.

Where is dave?

As for the rest, the original owner of the 29'Commander has e-mailed the letter that Tim asked for last night. Tim is sending said letter to his attorney this morning to make sure it covers what he wants covered. (In my opinion it does after reading it).

Tim should be depositing this guys full amount into his bank account at some point this afternoon providing the attorney gives it the all good. If for some reason he doesn't, then by all means.. Get your gas cans.

In the meantime though why don't some of you guys put down your pitchforks and sing kumbahyah around the campfire for a few hours, because I suspect by this afternoon this is gonna be a non issue..

What I will say is I have seen in the last 15 years on boating message forums, over 100 of these threads.. and 90+% of the time it came out that the story was waaaayyyyy different then what was posted on the internet. This goes all the way back to an MSD box that Rex Marine sold, to an Aftershock that was half burnt and parked in front of a building etc.. and yes especially includes the last time OCM took a bath on here.

You say smoke and fire because there was a previous thread. As it turns out that guy wouldn't provide titles for a year.. You wouldn't pay a guy if he won't hand you the paperwork either.

The problem is nobody ever talks about that after any of these threads. They just remember negative and business name.

In the last thread I saw a copy of the titles, and I saw the date they were generated on, and they were generated right about the same time his lawyer called the newspaper.. It was a smear campaign that was entirely "smoke and mirrors" (pun intended.)

If you have a legit issue with a business (like the proposed one above) then the proper course of action is to get a lawyer and deal with the business.

And believe it or not Phil.. Yes I have been fucked over a few times in the marine industry myself. Even right now I have a company that owes me a grand.. You don't see me blasting them on RDP, so stop with the insinuation that I wouldn't do as I say.. Because I absolutely post by the same rules, that I have asked the members too.

Now an attorney needs to be involved? Ya this guys legit. Typical, rob Peter to pay Paul is what's happening here. Seemed to work well for The Boat Broker here in Upland.

In the interest of full disclosure, I would say that thread probably expedited shit a little.. LOL I can't hypothetically guess what would have or wouldn't have happened without the thread.

What I will say is I don't believe (my personal opinion) Tim is out there twisting his evil mustache looking to screw people. If I had inkling one that he was then I wouldn't have a boat down there on consignment right now. I think he has a public relations disaster on his hands right now. The Frisini bullshit (which was Frisini not Tim), The Collins thing (which was Collins demanding payment without handing over titles) and now this thing (which who fucking knows... or at this point cares).

The fact is though 6-8 boats a month go through OCM, which equals 72 boats a year with over a decade in business. Out of 600-700 boats he has had three real deal Public relation problems.. 2 of which I happen to know are nothing to do with Tim or OCM. The third (this one) should be resolved this afternoon.

I don't have access to Tim's bank accounts nor do I want to even know.. I would say it's easy to see how you can come to that conclusion, but I do not believe that to be the case.

My thoughts exactly...The original posters intention was to be paid and if all is as Dave says then that'll suddenly happen. Done deal.

Just because it is/will be resolved, doesn't make it a non issue.
The underlying facts still remain though and it'll be anyones guess as to their validity, most of it will still be speculative by the consumer world.

Amen to that....I don't ever get involved in these threads because they usually end up with the truth in the middle....but you have multiple problems with one vendor, from multiple sources who are telling somewhat similar stories. It sure appears that this is being run like a pyramid scheme....keep one guys money as long as possible, eventually make good after being threatened or legally forced to pay up, then rinse and repeat. Always catches up with you....:rolleyes

Dave you are spot on with what OCM is going through, except the delays. Any person in business can tell you of transaction that went less than ideal. If you are a good business providing quality, you will still have a few people over the years you can;t please. 99% satisfaction is pretty damn good in my book no matter if you are building multi million dollar houses or selling widgets. The fact that people have the internet today to air their dirty laundry is just a fact of doing business. It sucks, because even if that negative post is totally wrong , it is still out there. As a business owner you have to have the positive results put on the internet also. It is weird to me to ask people to give their positive feedback , but in the long run those will out way the 1 or 2 negative ones. I'm not taking sides in this matter, because I went through a similar deal and I feel all boats dealers are shady, this is just my take on the situation.

IMO, I will say that I think it's just as important for us all to be aware of things, good and bad. Props go out to good business practices, and in this deal gone bad (not the first time), our boating community should use their best judgement.
In these types of situations I sometimes ask myself, would I send my mom to this place (any place) to do business?
Btw, my "gas can" is empty.

Except they aren't similar stories. They are very different stories? Other then that small problem though.. LOL

1. Had to do with a failing boat mfg. OCM went way out of their way to protect the customer, and funded the money as soon as the customer asked them too.

2. Customer never delivered titles to the boat, and was demanding payment. (I saw the dates the titles were generated on, it isn't up for debate)

3. This story.. Which if all goes well he will be funded today.

So of the 3.. You have the third which is a dissatisfied customer.. The reasons as to why he wasn't funded are really debatable, and get into a bunch of he said / she said shit, of which is no interest to me. So long as the guy is made whole today it doesn't matter.

Dave you are spot on with what OCM is going through, except the delays. Any person in business can tell you of transaction that went less than ideal. I read a statistic that people are 27 times more likely to say something negative on the internet then something positive. I believe it.

I don't think people realize how much effort we put into RDP to keep this as a positive boating site. If you go onto most forums, there's thousands of threads of people blasting businesses, and other members etc..
