Can I please interject here with some practical advise. I am not a banker but send wires on a regular basis. If you find yourself in a situation with your nuts on a chopping block. Drive down to the bank. Go to the business window. Have the banker manually fill out the wire form. Do this @ 9am PST when the bank opens. WTF is so hard about this?

I can't believe he didn't walk his ass down to the bank and do this is in person to ensure that there were no problems.

I have done numerous wire transfers to people while I was in one bank and they were in the other and everything was confirmed and done before either of us even walked out of the branch.

This whole deal is fucked and even if the guy does get paid by tomorrow I think it's complete bullshit that it came to this for this guy to get his money.

Exactly this. Seems common sense isn't so common.

Not withstanding a branch visit, online wires are faster, more efficient, and more problem free than walk in branch wires, too...

Seller set the date of 12:00 tomorrow. I just informed the seller what I witnessed at Ocm. If he is willing to wait until then and Tim is prepared to provide the information and funds before then.. Well then it is what it is..

No, not the case as I have learned. The new owner has 60+ days of running ARCO 87 octane gas through that engine "Balls to the Wall" before the seller gets a dime. No telling what the stereo has endured. :)

Dave, I watched Tim call Chase on speaker phone in his office. I sat there with him on hold.. I listened to him get transferred to the chick. I heard her say with my own ears "I don't have a Federal #, and it's after 2:00 so I can't get one..." I interjected into the phone call and asked her point blank "With this confirmation #, can you verify that a wire was sent to (sellers name) in the amount of 59,174.00??" She said point blank, "I do not see a wire transfer." To which I asked point blank "Does that mean the wire was never sent????" She said "Was it done online or in the branch" Tim said "I did it online this morning, and I have these e-mails that say" The lady didn't skip a beat and said "If it was done online it will take 24 hours for us to see it in our system."

I asked her point blank "Is there any possible way to verify that this wire transfer was sent today?? Some other way?" The lady at Chase (her name was Meagan FYI) said "No."

After having listened to 2+ hours of phone calls.. Trying to reach the sellers bank.. Trying to track down the Federal #. Trying to get someone at Chase to verify anything.. After all that I said "Fuck it.. I'm going home" and told Tim to get the Federal # first thing in the morning to set the seller at ease, and make this PR nightmare disappear.

New guy chiming in, I'm a dealer (auto), this paperwork that he needed that says it free of liens was just a ploy for more time, I do consignments every day and the first thing I do when a vehicle/ boat/ whatever is brought in is run a title check for liens and child support holds, I don't care if it belongs to my best friend, it's how you run a business. If there is a lien I know the 10 day payoff at all times, when the vehicle is sold the lien holder is wired the payoff and the owner is paid his balance. This is done the same day or the following if the deal was done at the end of the day. Making someone wait 30 days for their money? That's a person "floating" their business, I've seen it way to many times. Sorry to be the bearer of bad news, it's just not right.
I also do wires just about daily, when I send one my customers a wire he/ she has always received it the same day, usually minutes after 1pm est. When I'm owed money by someone who doesn't have it, these are the same stories I've heard, and I've heard them many times. So, Dave, I feel bad that you spent this much effort on something that doesn't make you any money, hopefully he's sold something from his personal fleet to cover this, that's the only way this is gonna change.

Side note, I don't know either party, so this is my unbiased opinion.

For a $60k transaction...I would of drove or flew down to OCM...then we both would of taken a ride to HIS bank and made the wire transfer at his bank into my personal bank.....WTF?
Common sense is definitely lacking in this transaction for sure.

I already posted the reason why in the earlier threads. To answer your question though (again) it was because it was posted on here. If I delete it then obviously I'm protecting the vendor and an asshole for not warning people. If I don't delete it, it goes against the policies of RDP mostly because in 90+% of these situations it rarely is the actual business at fault. I want to be clear on that for the reading impaired like Tyro.. There is a 10%.

Tyro you really need to go back and reread all of my posts in all of the threads. For the 100th time just because I'm not willing to burn someone at the stake based on "heresay" doesn't mean I'm taking sides, or backing one or the other. You have to give the person a chance to make it right, or explain, or make someone whole etc..

We went over this 100 times yesterday with the gas cans, or blowing OCM.. And I thought it was pretty clear about how anybody can paint a picture when I lightly touched on your own experiences in the matter.

The seller wants resolution (obviously). Tim and the seller came to an Agreement with Terms, all that I have done was listen to the terms of the agreement. As of yet the Agreement has not been honored. That being said there is some amount of EVIDENCE that it was attempted to be honored, and it could be a hold up outside of either parties control. (Whether that's bullshit or not.. we dunno but I suspect we will find out tomorrow morning)

The seller has agreed to extend the terms of that agreement until 12:00 tomorrow based upon that evidence that was produced. The seller does not believe that the terms were honored, but figures quite literally "Fuck it.. What's another day at this point."

The seller has made it very clear that if the terms are not met by 12:00 tomorrow that at 12:01 he will be posting yet another thread. Tim has made it clear that if the seller doesn't have the funds by 12:00 tomorrow he deserves whatever he gets.

Me personally off to the side (in running the board) am going to publish one of two things tomorrow. Either OCM honored the agreement and all that entails.. Or OCM didn't honor the agreement and all that entails.

I have given Tim the BENEFIT OF THE DOUBT, because unlike you and most on this board, I have referred him business. I watched the transactions go smoothly. I watched the checks get cashed and they did not bounce. If for some reason this time is different, Well then I guess this time is different. Just walking up to the situation though, Tim has purchased all 3 wood boats from Dan Donahue SR. I'm the guy that put the deal together between Tim and Dan.. and it literally took one day and Tim said "I'll take them" and as soon as Dan got him the title's Tim wrote him a check. So again I'm not so quick to say "fuck this guy" because my experience with him has been good up to this point. I Know people that have sold and bought boats from OCM that have had positive experiences and shared them with me. (as said previously in other threads)

RD also said, no excuses and threads would be unlocked.

When both the seller, and the Broker agree to extend the terms until noon tomorrow, it would seem to make sense that we would leave things as they are.

Did Mr. Donahue sell his boats or are they still at OCM?

If they are still there should he not be made aware of any potential problems?

He should still be made aware of this situation. He deserves the right to make his decision regarding his property.

Being that I was the person that put the V-drive down at OCM. I called Dan Donahue and have completely informed him of the situation, and my opinions of what actually is going on. Dan is sending me power of attorney for the v-drive, and whatever I decide to do with the boat will be happening tomorrow. Whether that's leave it right where it's at.. Or pull it out and rip it over to Prime Marine.. Or put it in the water and take it up to Topock tomorrow for their pool party. I talked to Dan, and we are on the same page.

I haven't steered him wrong in anything to do with his sons boats since Danny's passing yet. I'm not planning on starting now. He has faith in whatever I decide and why I decide it, and yes I have already decided exactly what I'm doing with it. I am treating it no different then I would treat my own boat.

Sold the wood boats. The rc is on consignment. If there is no wire at noon I'm sure Mr Donahue will be removing that boat shortly after.

Dave will be driving the wagon.

If there's no funds at noon, as said before then all I can say is the Agreement wasn't honored..

I'm handling the situation as consistently as I can. People that have reading comprehension problems, need to re-read the threads.

Hopefully The guy gets funded before Noon tomorrow, or in my opinion OCM did not honor their end of the agreement. If the guy gets a Federal transfer # in the morning, and gets funded before Noon, then OCM did honor their end of the agreement.. It really is as simple as that.

What happens after either of those circumstances is what remains to be seen. If they don't honor the agreement, then from a public relations standpoint they are fucked 6 ways to sunday.

IF they do honor the agreement then Tim will start the process of changing OCM's image online and he will likely pay me to help him do it.

That is as honest and as transparent as I know how to word things. I really don't appreciate some of these guys like Joker and Tyro joking about my integrity. It is something I have always, and will always take very seriously.

RD, I can agree with a lot of what you said and am all for giving someone the benefit if the doubt. The problem I see is the same wasn't given to the boats owner. It has constantly been I cant see OCM doing this and or stringing him along. All signs point to the original post with all the issues being real and continuing. It sounds like every time there is a new plan (forgive me for not remembering his name) seller has been forced to just go along with the flow to get his money since his only other option is legal at this point and dwindling his money. I'm sure he will get paid and maybe those funds have already began to be transferred. So at this point I would say it was a valid complaint that started this and I'm sure you are helping to resolve with or without being directly involved.
