Many of you are starting to use GoPro on your boats. If you provide me with video of any vessel including PWCs and kayaks violating the nav rules and creating an unsafe condition, I will pursue it if I can identify the vessel. The lack of hull numbers on kayaks makes those difficult, but some...
Ziggy, before going in to work that day I submitted an electronic comment to the email address provided for public comment on the CD. In my comment I suggested that if we took the 20% or so of the center channel which lay on the Arizona side of the state line and excluded it from the proposed...
Hmm, interesting. Not sure how they can enforce a more restrictive law than their state legislature has approved, but I obviously don't know all the relevant detail. Thanks for making me aware of this.
Milkman, as I have stated repeatedly I am offering personal opinions and some...
singleton, now I need you to educate me. Which two agencies are you referring to? Are you saying AZGFD and MCSO both use the stricter CA code on the Arizona side of the river as well as the California side? If so, that would be news to me and I don't know how that could stand up in court. I...
I finally tracked down the California law which states "14 CCR ? 6697 ? 6697. Prima-Facie Evidence of Negligent Operation.
Pursuant to the provisions of Section 655 of the Harbors and Navigation Code, the following described acts endanger life, limb or property and constitute evidence of...
Anything with PII to include name, date of birth, SSN, address, phone number, etc is generally going to be safeguarded as per Federal law. We have an agency FOIA rep with whom I believe you are familiar who could best advise you on obtaining what we are allowed and required under the law to...
Sorry, Singleton- I'm not going to divulge any details which would reduce the effectiveness of what we're doing. I would note that while audio recordings are highly regulated and require a warrant, with photography the courts have generally used a "right to be, right to see" philosophy. If I...
Is this JS? That is correct for Arizona and I enforce Arizona law; however, it is my unresearched understanding from other officers that CA law is more restrictive so I encourage boaters operating in places like Havasu with both jurisdictions to research that further. I was not able to attend...
Where I have offered an OPINION, it is my opinion and not reflective of my agency's policy. In this case I am sharing INFORMATION which I possess because I wrote that citation, but I am still off duty as I write this post. I don't particularly enjoy being slandered by individuals who can make...
That citation was accompanied by a photo which showed that they were clearly above wakeless speed with two on the transom and one on the gunwales. Also note differences in AZ versus CA law. They can of course contest the ticket in court where all of the facts will come out, rather than on...
You're misusing that particular fallacy, but you are correct that proving causation would require both a random sample from population and random application of an experimental treatment. In this case, I'm just talking about statistical sampling. I took graduate level stats too and hoped I'd...
Joker, buoys were placed on the Arizona side of the lake outside the marina itself. Any vessel entering the zone was subject to being directed to an officer waiting on the shore. Captured primarily boats passing the island and going south to north, but also a few boaters who violated nav rules...
River mobster, I was asked earlier in this thread for numbers on the Site 6 checkpoint. I have provided the number of arrests and number of boaters contacted. The protocol probably makes it statistically reasonable to cautiously extrapolate a bit beyond the actual sample size, in my opinion...
AZGFD indicated they will be releasing a press statement. I asked for and received approval to give arrest and boat numbers only and will let agency release the rest as they deem appropriate.
Protocol is to start with every boat that enters the marked zone. If officers are overwhelmed, only every 2nd or 3rd boat is sent in. So you do have the random selection aspect that a statistician would want to see before attempting to extrapolate to a larger population.
Eight OUI arrests out of 128 boats stopped- that's about one drunk boater per 16 vessels you encounter out on the water. Now scale that up to say 5,000 boats on a busy weekend.
I do not represent my agency when I respond on my own time and explicitly state that I am offering my own opinion. Were I in agreement with you, I suspect you would celebrate my defection but regardless every person in this country has a right to have and express an opinion, and I shall...
