this is just plain ol business failure, no theft, no illegal activity,..what happens is the over head goes above profit...the flooring company was the only partner making any money,.. and at the end, they just didn't make as much as they thought...they made money for 3 years off the arm...in the end, didn't go so good...the amount they were in the hole was an amount that was carried forward..that amount just kept getting larger...to the point that they need to file bankruptcy .....no body walked out the door with a bag of cash... no one is hiding... embarrassed of failure maybe...

I used to have a small ownership in a motorcycle dealership. I literally just spoke to one of the partners yesterday that keeps in contact with a number of other huge dealers. He has recently seen slow downs in sales and the dealerships ask the line for help on flooring costs. The lines have said they will forgive the outstanding flooring costs/debt if they take a large number of additional units. Basically, you may see some dealerships get in more trouble soon by taking additional units to just try and keep their head above water, but we all know how that pans out.

this whole deal amazes me,... I for one don't get joy out of others failure..takes a lot to finally say,... I work for no man..put it all on the line to start a business...I can see a competitor happy to see them go,... but when you got no dog in the fight,... just wanna see dogs die...that part I don't get.... I shopped there..thought it was a good deal and bought a couple toons...now I just wish I would have paid 20 or 30k more for each....so I could laugh at the others that got that deal.. fuc… I feel horrible..

Ever seen the truck driving around Havasu with a full vinyl wrap warning people about cactus ? What happened to that guy?


I have not seen the truck you describe but have found multiple complaints posted online alleging theft, fraud, embezzlement, etc.... but please keep in mind this is just plain old simple business failure as stated above so all those people filing the complaints must be wrong. Just ask ol Barry if he got his 90K back yet:

Well, I have waited roughly 9 months to write this review as I was trying to give the ownership as many chances to make it right as humanly possible - also, documenting each and every phone call, e mail and text along the way. Can't say I haven't given him the chance to earn 5 stars!
I met the owner, Scott at the Los Angeles boat show in January, 2019. My wife and I were there looking at different boats focusing on the upper level tri toons. The Godfrey rep (Makers of the Aqua Patio) introduced me to Scott as his dealership, Cactus RV had the upper level tritoon with big motor and slide that I was looking for.
After quite some time dealing with Scott on the actual boat itself I told him and the rep that I was hesitant to move from a performance deck boat to a tritoon mainly because I like the horsepower and the sound of the V8 on my current boat. Scott's exact words at that point was well your in luck because the motor on this boat is Mercury's new top of the line V8 and has a push button function on the digital dash that enable a "sport tuned exhaust". This feature opens up some fancy thing on the engine and you can hear the roar of the V8. At that point, I said ok that was the final selling point and made me sign on the dotted line.
I bought the boat and paid "show price" of a little over $90,000.00. Scott asked if he could keep the boat for a few more weeks so they could do a photo shoot with it - I said no problem as it was still winter anyway.
Fast forward to March - we go pick up the boat from the dealership in Havasu - go for a test ride on the lake with the dealerships (I'm told GM) Shane. I asked Shane how to put the boat into the sport mode - his response "you know, they trained us on how to do that but I cant remember how to do it". I thought ok that's a bit odd however as I was told it was a brand new feature from mercury maybe he simply doesn't know. I told him not to worry, If I couldn't figure it out then would reach out - he said for sure.
Fast forward again to May when season is here. I take the boat out and can not figure out how to turn the option on - call Cactus Rv for help - none could be given. I call Mercury - provide the serial # for the engine and to my SURPRISE was told the engine does not have that feature and that is only on their Verado's - an upgraded engine.
As you can imagine I immediately call Scott (the owner) and ask him if he remembers our conversation and the final selling point for the boat was the engine and that really cool feature - he says yes, how is that? I say, I have no idea as the engine doesn't have it. Silence on the phone - Scott says to me he will call the rep as the only way he knew about that feature was because they trained him. I said, that's fine but the correct engine and everything else that goes with it needs to be installed at no charge ASAP. He said would get back to me and not to worry as "he's not that guy".
Fast forward again to now, roughly 7 months or so since alerting him - still nothing corrected and still nothing resolved. Excuse after excuse, delay after delay - last response to an e mail or text was in August stating the new engine should be in and would set up for replacement week after labor day. Have not heard a thing from them since then and will not respond to anything.
In the last two weeks I have since filed complaints with the BBB as well as the Arizona Attorney General's office - consumer fraud division. This is being done as further documentation that I have taken every step possible to get them to correct their "mistake" prior to filing a federal law suit for the total purchase price of the boat and fees.
Unfortunately, I liked Scott and wanted to believe he was an honest/ethical business man who simply made a big mistake - however his actions or lack of have proved that he more than likely is "that guy". He got over $90,000.00 from me and that's where the service stopped as nothing has been handled.
Additionally, the boat had some damages on it and trailer looked like it was 5 years old when picked up. All of this was documented and I was assured by both Shane and Liam (service manager) that all will be handled - they just had to order the parts from Godfrey and the trailer would be re painted, no issues. I'm sure you can guess, I cant get any resolution on these matters either. Liam has informed me - he cant do anything without Scott's approval...
I will update this review upon conclusion of this saga which is either going to be Cactus RV providing me with what they actually sold me and finally making it right or an update on the federal law suit as they sold me a $90,000.00 boat based on fraudulent information.
Plenty of dealerships out there, I understand cactus RV owns two of them, Lake Havasu and Phoenix or Tuscon area - do your due diligence prior to buying as I wish I had done. It seems this type of treatment is not entirely new to this dealership.

I had this same scenario with certain toy hauler company with the initials WW. I already had my lemon lawsuit rolling, I got a call from my attorney and he said we need to wrap this up NOW!. I got my check, few weeks later WW was gone.

So nobody was in court pleading guilty to fraud charges?

but as you know.... nobody was in court...but some one did file BK that you know about....right???

As 2FF says, and I agree with, anytime a dealer fails and closes down, it's a bad thing. I look at it this way, usually the management/owners make poor decisions. Either intentionally misleading, or promising too much. Those decisions take a toll on the buyers, but when they shut the doors, the employees. That's where I get ticked with the guys making good money getting greedy. Their mistakes cost others their livelihood. One or two names hit the papers, but a lot more have to hit the streets.

As for another shop filing BK, don't know. Have no skin in the game, but always looking for good auctions;)

Cactus RV LLC most definitely had their share of court case records. Public info.

I guess it's top secret... dave will spill the beans when he's ready ...seem kinda weird that cactus was in court already... and even more weird that they filled criminal charges, and went in front of the judge already... but, I was not there... so can't say..so was it todd that did the guilty plea?

If you read the court docket there was a request made for return of missing property and a summons issued for the defendant . Things that make you go hhhmmmm.

nothing personal here... just knowlage of how all this works...and that's the reason for the llc… flooring co. can get a cort order to seaze assest, but if there are none... sol...

I'm sorry the Barry o story is stupid. You wanted an outboard to sound like a big block. Go down to the channel and listen to all the bad ass outboards put along... Oh wait you can't hear them... I will admit the new v8s sound mean but there is no replacement for....

The other story I really hope isn't what I'm thinking it is....
