Interesting --- Where I live there's no HOA and those of us living here do own the sections of road on each of our own properties, collectively, paid for them initially and collectively pay for any repairs and maintenance.
However, and lacking my knowledge of the legal terms we've waved our rights to prevent public access because 30+ years ago, a gate was never constructed restricting public access, we've waved our rights to prevent public access.
Yes, we have a sign that clearly states " Residents and Guests Only", legally, it's just a suggestion, or respectful request.

Where it does get a bit legally sticky is the issue of liability. In the well over 30 years I've lived here, I only know one case of an owner getting sued. In his case he was quite wealthy (Nice target, unlikely to contest a modest settlement) and the case of a real asshole nearby resident allowing their unlicensed, and unskilled son to ride a motorcycle, laying it down attempting to make a u-turn, then suing the property owner as if it was his fault.
These are the types that set precedents that make life harder for everybody else.

If you come here and act respectful, you'll be treated likewise. If you choose otherwise, or encroach upon obvious private property in an attempt to access the mountain or lake behind us, this neighborhood is well prepared to respond accordingly and does. 😁

I live this! I left a couple neighborhoods because liberals don't like kids playing outside. It's F'n craziness. Apparently, people want kids inside playing video games or on drugs or something instead of being kids.

I had an issue with my kid riding his pit bike up and down my street. A retired fireman got into my 10 year olds face screaming at him. I was in the garage and he came back scared so I jumped on the pit bike and did hot laps...after about 15 minutes an old fat guy with a neck brace comes down the street and started to get loud and then became very nice. Moral of the story, don't try to get into someone's face with a neck brace on.
