Baseball as a kid has paid off!! Scary stuff, glad it worked out.

I'm usually by myself and one night someone was banging on my trailer door at La Paz state park. I reluctantly opened to door to a single woman who was camped right next to me. She had gotten the holy shit beat out of her. As I was trying to talk to her the coppers rolled in. I guess a group at the tent camping area did her up.

It's mentioned here several times that if shit goes down and LEO's arrive to STFU and call your lawyer.
I don't have a criminal defense lawyer on retainer, I don't even have a name of one...let alone a good one.
And in a situation like this, I wouldn't want some random dipshit from Brawley to represent me.
What is the process of finding a good criminal defense lawyer in the middle of the night in Ocotillo or Glamis or anywhere?

Their first question is going to be why did you open the door? Why did you not call the cops?

All the logical responses in the world aren’t going to get around the basics..

This is why you don’t answer any questions, invoke your 5th amendment right to silence, and ask to speak with your lawyer.

Note that sitting silently and not verbally invoking this right, can also be used against you.

And don’t state “5th amendment right to self-incrimination” because those last two words have also been used against people in court.

After reading this several times, I am convinced you should begin to Proof Read before posting, replying etc.
Apparently you're a tad dense?

The statement reads that I'd far rather encounter the guy with pants on rather than pants off......But maybe you would enjoy the view of him being naked waste down. Only you can be the judge of that.

Your couple weeks here and 50 some posts are showing you to be on the feisty side. Again, I have no clue who the hell you are but you seem to have an attitude and lack of a sense of humor. Comprende?

This is exactly why anyone that carries needs to have a contract with an attorney group like Texas Law Shield. Not only are they the experts and tell you what to do, LE will respect that right and understand your silence.

Even in a good shoot situation, there will be an investigation and why chance some liberal DA trying to make some political point at your expense. Murphy's Law has a habit of making the simple complicated.;)

Honestly I don’t think LEO would see it that way.. or a DA.

If I went outside with some tweaker and things got weird and he started running towards my home or rv etc...

Their first question is going to be why did you open the door? Why did you not call the cops?

All the logical responses in the world aren’t going to get around the basics..

Old days I’d open the door and not think anything of it.. being crippled in Billdo’s situation I’d call one of my buddies in a neighboring trailer and ask them to look and see wtf is going on.

Being hobbled/crippled ya kinda change your whole thought process on shit like this..
That's exactly why I think a good guard dog with tweaker stopping capabilities makes good sense. 60-100 lbs of bared teeth and aggressive capabilities leading the way pretty much put one in the superior position against even a small group of ruffians.....;)

Don't keep your weapon where you can't get to it quickly when it's needed.

Damned straight....That guy sitting in front of ya when you open the door gets immediate attention. The deep growl sends out a signal the most inebriated tweaker recognizes:eek::D

2.1 seconds. ;) to any gate, door or fence line.
My buddy has that sign for his Doby.

"He can run to the fence line in 3 seconds, can you?"

:D

Does he get any special treats if he brings back tweaker carcass?

My wife wanted me to put a similar Doberman sign up. I choose to leave them down as I don't want to get sued or anything. Dogs are a very good deterrent though, especially big dogs...

If you would have had it, would you have shot the guy? If so I’m not sure the self defense in California would fly? Especially if you shot him in the back while he was running towards your trailer?

nice throw With the Rock by the way!!

With this ankle being all f’d up, if shit like this happens I’m pretty screwed unless I shoot someone.. in which case I’m screwed again.

can’t hardly fight with one foot. Certainly couldn’t run to save my family. Etc

No, by his own account the tweeker did not pose a "threat" to him or his family at all. He'd have been screwed if he shot him. Running towards your trailer is not threatening your life, but also it is just fine to shoot someone in the back while they are running in certain conditions.

Correct the use of deadly force would not have been justified in this scenario.

The better play would have been to subdue the tweaker and tie him up to prevent him from continuing tripping and falling on his face repeatedly. While we wait for the cops to arrive.

In all reality this scenario played up as good as could have.

Yes the dogs were in with my wife. In our camp it’s not uncommon to have a friend come knock on the door so it didn't phase the dogs. Our new trailer is so well insulated nobody could hear anything going on out side.

Agreed. Best result you could hope for here.

Crazed Tweaker takes off running towards a trailer with my wife and kids in it he's forfeited his right to live.

That’s well and good.. if you kill him you are forfeiting your freedom unless you come up with a story that he was trying to kill you and stick to it when the cops come.

You simply can’t shoot someone in CA unless they are threatening you or your family’s life.

You don’t have to be in fear of death and it doesn’t only apply to family.

a person may only usedeadly force” in self-defense when they are in “imminent danger of death or serious bodily injury.” And that belief, that you are in imminent threat of death or serious bodily injury must be a reasonable one.

Nice work Bill. I deal with Vagrants and Tweekers frequently on my work travels. Keeping some distance, like you did, is key. Glad it all worked out for you and the Family.

Oh by the way, I know of a softball team looking for a short stop. LOL.
