So a couple weeks ago I contacted a guy with a .06 lot across the street about selling it ,we met and talked ( I won’t make a deal over the phone always face to face ) we settled on 33K if renter paid rent this month 35 K if he didn’t and we had to get him out Ok we shook hands on the deal I said let me give you a deposit 1000 -2000$ what ever he said No , deal is done it’s yours don’t worry about it , I was going to cash him out but wifey said just get a small lone we will pay it off by Xmas ok so I walk this guy all through the lone I will have your $$ on next Wednesday he said great so I drive home today sign papers Am , on my way home I texted him and asked if I could walk the property he answers Yes go ahead But I got a better offer I said there is no better offer we have a deal we shook on it ect so this Fucking POS just calls and said don’t worry about going to the bank I sold it for 40K . The fucker lives in St George ,Ut Tom Benson aka POS . Works for power company .

First clue that he was playing the field and not to be trusted, is when he didn't take a down payment. Usually there is some paperwork that accompanies the down/ good faith payment. When he said no need for the down, I would have assumed he was entertaining other offers. With that said, he wasn't a dirtbag, just a guy looking out for number 1. A dirtbag would have taken the down, sold to someone else and absconded with your money. So perhaps it is aggravating, but it could have been worse.

So I went ahead and contacted the seller and told him what you guys were saying about him. He said he felt bad and sent me a video of how upset he was....

I sold a Kubota tractor a few years ago. Had a guy on his way with the cash. Made the deal over the phone. I got a call from a guy who was ten minutes away and offered $500.00 more than my asking price. I told him no but if the other guy didn’t show I’d sell him the tractor for the same price. My word is more important than money. The first guy showed and bought it.

That is terrible I am sorry to hear about this we had a lot near us we tried to offer cash at market value and the havasu realtor fooled the deal up for 500 dollars on the bright side maybe the owner is one of those who will file bankruptcy to screw over his creditors in six months and you can get it for less in August

Honestly, you should have paid him right away to secure the deal. There are sooo many flakes I usually won’t take a deposit and tell people the first guy that shows up with a check owns it. Nothing personal just business. I took a deposit on my boat the other day and we are waiting for his financing. I just got offered $1000 more for the boat but I shook the first guys hand so I’m sticking with him. Probably was a mistake to take the deposit since people are knocking down my door to buy this boat but oh well.

Consider me “old school” but I was raised that a mans word is gold. It has burned me multiple times but I refuse to change. Really comes to light when selling stuff, especially on CL. If I make a deal i honor it, seems to be about 50/50 nowadays. The responses i get when people offer more and I tell them I already have a deal pending are priceless. Burns me quite a bit, but if you give me your word or a handshake deal I respect that.

Deals come and go.... some are good some are better! Just remember that perception is everything! I shook hands on a boat deal 5 years ago on a nice spectra that really only needed a re gel (IMO) it was s***t brown in 3 different shades ugly for 10k, I was to bring him cash the next morning at 9:00 mind you I viewed the boat at 7:30 pm after I got off my shift. I got there in the A.M. with a smile on my face and cash in hand only to be told " Sorry, I sold it last night for 9k" Money talks and bullshit walks! I don't go to view anything w/o having cash with me now! I learned that lesson from him that day and I wouldn't have been able to buy my Schiada 3 weeks later if it wasn't for him and his decision. I am much happier with my superior boat and didn't have to fork out 15-20k for a re gel so to him I say thank you! Schiada's Rule!

Let someone else correct me, but as I recall, real estate deals are in writing, no contract, no deal.
I tried that he said a handshake is good for him , I had 4000$ in cash when we made the deal and he said no worries deal is done .

That sucks. Once I make a deal it’s done. I don’t care if someone offers me more money after the fact. My thought is, if you want more money then you shouldn’t make a deal in the first place. At the end of the day my integrity is worth more then a few extra bucks.

Any of you had a “deal” signed, sealed, delivered only to have the buyer back out? This is a two way street.

It happens. I made an offer on a property that was on the market for a few weeks. Realtor gave me the impression it was a done deal and my offer price would be accepted. Supposedly greased the skids for me. Right. Get a text the following day my offer was rejected two hours before the offer deadline. Started playing the highest bidder game because out of the blue there was another interested party making an offer. Long story short, I did not get the property and received a dagger text from the realtor stating it sold for X with a smiley face. Felt like a big FU. Just the way it is. Can’t take a persons word a face value anymore. I do feel I got played and the other party was making offers all along. Like eBay.

Very true, but that’s also someone taking the easy route (some D’s are needed) and it’s so common now, why not.
The younger generation think that marriage is all fun and games without having to put in the work to keep it healthy, first sign of trouble or hard times and it's deuces✌on to the next victim. My grandparents were married for 61 years, my parents for 36 and still going strong. My grandfather said to me when I asked him what the secret to a great marriage was, " as long as one of us is still in love with the other there is enough love to keep us going together just remember the reasons you fell in love in the first place and you can fall in love again" I miss that man!

If you had the cash available I'd have just done the deal and gotten the loan post purchase. The fact he refused your deposit should have been a red flag.

If you had the cash available I'd have just done the deal and gotten the loan post purchase. The fact he refused your deposit should have been a red flag.
I had the cash but he said when ever works due to he had a lot of stuff/ crap to move he was ok with 2 weeks so we went with a quick lone , wifey likes the cash readily available 🤪😎 for future projects I was trying to give 2-4000 $ .deposit but his handshake was shit , o well it does give me pleasure that I can tell anyone Tom is a POS

Anything else is just foreplay without an ending. For all he knew, you could flake and not come thru with funding. Sorry OP but this should be considered a lesson learned, not a blame to the seller for maximizing his deal.

No I told him what ever deposit we gave was un refundable if we don’t come through in 2 week , if it would have got n close I would have took wifeys cash 😳😎

As a seller it's not a deal until money is exchanged for goods or product. With free advertising now a days there are so many flakes that make a handshake deal only to never be heard from again. Only way I'll hold something is if there is a deposit but even with that they have X amount of time to pay in full and take the item. Only time I'll promote a handshake is after the deal was made and it was a respectful deal. If they made the deal a pain in the ass, no handshake.

If a guy wont sign a contract and take a deposit he isnt ready to sell.


Like others have said real estate contacts must be in writing. I wouldnt buy anything without clearing the title that doesnt happen overnight.
