Looked up "attractive nuisance"- http://www.harperlawaz.com/blog/2013/7/29/the-attractive-nuisance-doctrine-in-arizona. Since bridge jumper was 20 years old he alone may be responsible for this. The idea of attractive nuisance apparently only applies when a minor is involved. It's an interesting legal concept. Reminds me of a time I was working in Alaska. The pilot who flew in our supplies in a Cessna on floats had a minor accident when he landed. Plane was beached for a while pending investigation. In the meantime a group of Native kids visiting for an environmental education camp (and well versed in the basics of small aircraft from a lifetime in rural Alaska) decided to jump in it and start her up. Another five minutes and they'd have probably been in the air, but one of their teachers caught them in time to prevent anything tragic, so we all just got a funny story out of it.

As an employee of BNSF and working the territory that that bridge covers I will state that there are numerous no trespassing signs all along the right away for the whole territory, as well there are 5 signs on that bridge per direction on both tracks.
You cannot put a fence around the railroad just like you cannot fix stupid, however about 15 years ago they put up railing as pertinence of a fence along the bridge to enact as a fence along the bridge. They also cannot block those ladders as those ladders are not meant to be a way up, but a way down incase of an emergency to train crew members like myself, in situation of immediate threat or derailment.
Yes a sign is not as strong-holding as an actual fence but those signs as well I do believe they are stencil spray painted on the uprights and across the physical bridge "NO TRASPASSING BNSF PROPERTY" will eliviate them from a suit against them. However sadly most the time the railroads will make settlement with trespassers that are injured as to stop an issue with a suit.

But that being said the rail industry has changed a lot in recent past and I see them countering any claim with a suit of their own, and you gotta have some seriously deep pockets to go against any Class 1 railroad specially one owned by one of the biggest corporate conglomerates as BNSF owned by Berkshire Hathaway!

If the concern is BNSF staff having an escape path down from the bridge, why not a fire escape style ladder that is pulled up and dropped as needed? BNSF could also ask MCSO to start prosecuting some of the trespass on that bridge. Signs without enforcement are worse than no signs at all in my opinion. Appreciate your insight as railroad employee.

If you need a warning notice that your coffee might be hot, or that jumping off a bridge onto a boat might hurt, then why don't we just let you kill yourself. And change the law so we can bill you for picking up the mess you left. Life would be so much simpler if the LEOs would let stupid hurt, and stop trying to protect the idiots from themselves. You cannot be there 100% of the time. Stupid happens. So why try to ruin everyone else's life, to try to save the idiot from themselves, knowing full well the idiot will still do it wrong..

Nope, he isn't. He shed some light on a topic that had been brought up by several in this thread and then stated the obvious about BNSF being a huge company and prosecutors needing deep pockets to go after them. The titties comment.... oh boo hoo..... go cry somewhere else.

I think it is absolutely horrible and soooo near sighted for anybody in the boating or off road life style to jump on someone from "the other side" that is willing to share insight and knowledge as to why and how things are happening or not happening. These people should be treated with respect as they are just doing their jobs and we should use that connection to help our cause as well. Not just yell and scream at them for some policies that higher ups control and they have zero say in. If we do that, we might as well just go block a freeway during rush hour. They both accomplish the same thing.

You are absolutely right, she was assaulted by an idiot, he should be charged with attempted murder and put away. But unfortunately what tends to happen is "we should shut the river down so no one gets hurt by idiots jumping of the bridge" even though it is clearly illegal already.

You missed the point being made, instead of punishing the idiot, the powers that be will find a way to punish the rest of us who were playing the by the already too strict rules. SRice, I appreciate your willingness to come on and try to have the conversation, however I personally would like the conversation to start with, we the people own this federal land and as such have the right to enjoy it freely. It is not owned by those in the tower who we are paying. There is too little respect given to the public and way too much "authority" being abused.

Please spend a month dealing only with complete morons, not families just trying to have a nice day on the lake. Instead of DUI inspections, sorry "safety checks", pull over the idiot running 20 through Thompson bay, or the jet ski who just has to jump the wake in front of us, or even an idiot running the river at 120 who intentionally roosted the kayak (btw my guess is you won't find too many of those). Every one of us, including you I am sure, has been affected by these idiots every time we hit the water. The safety checks are not making the impact you are looking for. That safety check should be accomplished at the launch ramp and used as education not enforcement. The idiots, lets try enforcement there.

You are correct all these agencies think they own us and the public property. They are nothing more than stewards in reality. Yet the try to be sole proprietors.

Joe, it's a kid that made a mistake and had some bad judgement.. There is no malicious intent here. While it sucks what happened, sometimes accidents do happen, even if there is negligence. Kids have to be afforded the opportunity to make mistakes. The fact that in the current era they aren't allowed to make any is part of the problem with society as a whole.

What you are suggesting could be applied to a hundred different scenarios.. Someone jumps off the top of a dune, and collides with someone else.. All of a sudden it's criminal because they didn't use good judgement by having a spotter? I'm not a dune guy so that's probably a shitty example, and for all I know it might be criminal.. i'm just saying it's a kid that jumped off something high.. Pretty sure he wasn't thinking a boat would be appearing beneath him. Shit happens.. Bad on the kid for sure, but I'm sure he's learning from his mistakes right now in the hospital.

Yes the kid made a mistake, but he needs to be held accountable for all damage his mistake caused.
IMO the jumper should have to pay all medical bills for the injured girl and reimburse boat owner for fixing all damage he caused to the boat. No need for jail, but he needs to pay to fix what he broke!

Yes the kid made a mistake, but he needs to be held accountable for all damage his mistake caused.
IMO the jumper should have to pay all medical bills for the injured girl and reimburse boat owner for fixing all damage he caused to the boat. No need for jail, but he needs to pay to fix what he broke!

And instead somebody will sue and he will be set for life.

My dad always taught me you can make 2 types of mistakes in life. One causes no damage and the other causes damage.
If you make a mistake causing damage to stuff you need to pay to fix that stuff.

I dunno Joe.. when I was a kid one of the most popular past times as going to Trestles and jumping off the train tracks into the ocean as the train approached..

I guess myself and everyone else should still be in jail for that.. Also did a lot of street racing.. I know I am not the only one that received two page fix it tickets.. but maybe we should all be fined for laying tracks on the pavement for reparations..

Lots of people blew up mailboxes with fireworks to home made explosives.. That is probably a terrorist act now?

This is some kids that were jumping off shit into the river.. one kid went big and it ended badly. I not sure sticking the kid up on a cross is the right thing here is all I am saying.

Joe I'm almost 40, and if I asked myself "what would be the worst that could happen if I got caught jumping off the Topock bridge". the answer would come back some bullshit misdemeanor ticket that I could pay out of what was in my wallet on the boat.. my primary concerns would be depth, possibly landing on a boat.. ear damage from the water.. not sticking the landing for the ultimate belly flop.. lol. a whole host of shit that would have nothing to do with running into some railroad chronie.. because if I made it to my boat Mr Railroad can kiss my ass.

Jumping off of high objects into water has been around forever.

Obviously the kid needs to be held accountable and the girl injured and boat owner need to be made whole. But geeze throw a kid into jail for a screw up that 99% of this board could probably top 10 times over.

Only difference is they got lucky.

This shit hits home to me. I have kids. I go to the river. To set out on an enjoyable time, only to end up in the hospital cause of somebody else's fucking retarded mistake, is why I never go to the river in the summer. Spring and fall only for me.

My heart ACHES for that family. My heart hurts for that girl. :(
