I stay on the "up and up" on AZ boating laws and we are one of the few states that dont make a mandatory requirement for boating education for kids. Not saying it is a bad thing I am actually for it for young kids especially when they are operating jetskis! We just had our 14 year old nieces take it to ride the skis.

Wheres "retired" boatcop when ya need him

Not in Az. You just have to be of age.

Ok. Well I'm glad he took the course anyways. My kid can handle our 34' with twins better then most people can handle a bay liner and he knows the laws and the do's and don't to go with it.

While I love the idea of tossing back some blue mountains and giving my kid the keys to my boat to drive me home drunk. I have to stop for a second and think.. Maybe that's not the best example to set for him. Again..I love beer.. And I love boats.. Beer and boats go well together but OUI and sitting in a box in Havasu jail would suck.

x 100.. I'm all for carrying, and support peoples rights to arms. But I have never felt the need to carry a gun on a boat before? I can't even imagine why I would need a gun while I'm out in my boat?

I asked the question just as a point of discussion since the gun laws are so different between CA and AZ. But maybe boating the lower Colorado close to Mexico may be one area you may think about carrying and having grown up boating in Fla that is one area you would carry especially if you go offshore a lot.

I think in this case your actual exact location regarding the state boundary may be paramount in defending your 2nd amendment rights regarding AZ law to carry... I believe at lake Powell they are more separate with the fishing license deal and this may be important with gun rights on the river...

It is correct that AZ does not require any form of Boater Education or kids or adults.

2 people are pulled over by 2 different agencies and enforcement of the more restrictive law would violate the equal protection doctrine. It follows that the least restrictive law should be enforced by all agencies on federal waterways. I'm only assuming the issue has never been litigated to conclusion .


Remember I said that the Interstate Compact states that the compact does not authorize conduct that is illegal in either state. So if it's illegal on boundary waters in CA, it's illegal on the boundary waters in AZ.

They have the right to search a vessel on navigable waters without probable cause.

Not "search", but examine the vessel and its documents for compliance with applicable laws. Cops or Coast Guard can't go rummaging through your glove compartment or personal effects (pockets, wallet, purse, etc) looking for PFDs or Fire Extinguisher. They may go through those things looking for the vessel documents, but cannot proceed further once those documents are located.

A couple notes about carrying a weapon concealed. If asked, you must advise the officer that you possess the weapon, and present it to the officer for safety for the duration of the contact. In AZ there is no CCW permit required, anyone can carry a concealed weapon, except in a few specific areas. (Airport security areas, government buildings, private businesses, if posted and secure storage provided., etc) Also a weapon carried on a means of transportation (motor vehicle, boat, motorcycle, etc) is not considered, if it's in a holster, case or scabbard within the confines of the vehicle)
