All this is blown WAY outta porportion but, hell, I'll thrown in my 2 cents.

Phil's step-son was in the wrong for doing what he did but for HOW he did it. If there was in fact doubt from Marko then the seller should have clarified with Marko before entertaining other offers since he had already seen the cashier's check made out. To me, and I think MANY of us out here, if you have an agreement like that set-up WITHOUT any statements by the seller of "whoever shows up first with cash", that agreement should be honored. PERIOD.

Cash is always king. I dont care for pictures of cash, checks written out to my name, or CC. If you want something that bad, youll show up asap with cash in hand or youre sol. When i was selling my pontoon, i had a handful of people set up to see the boat. One in particular, was "driving down from Sacramento" to buy the boat. I wrote that in quotes because i thought he was full of shit at the time. I told him the same thing i told everyone else, "Im not making promises to anyone. First one to Show up with cash in hand, gets the boat. Regardless of where your coming from." Saturday rolls around and sure as shit dude shows up at 8am to see the boat. didnt even accept my offer of water testing it. 8:30 rolls around and im texting the guy coming from san diego that wanted to see it at 930 that it was pending sale. Dude was pissed. called and texted me multiple times calling me an asshole for selling it from under him. How he was already in temecula yada yada yada. I apologized and reiterated what i texted everyone. Call me unethical if you want.

the way i see it is if you want the boat you have to be positive to the seller and not play around or you take the chance of loosing it ....

Basically its go for it or don't you can always back out in person if the boat dosent live up to the implied condition or equiptment... lot of B.S. out there

From what I understand it was just the full price offer and cash that evening, not sure of the exact timing

I dont know why Phil is doing all the talking, he is hearing what the guy wants to tell him. Once again, we struck a deal, he NEVER said he wanted a deposit or I would have done it immediately, no biggie. He said he was fine with a cashiers check which I sent him a pic of to show good faith. We made plans for me to come and get the boat Sunday, he got my address so he could mail me the paperwork ( misc. receipts and whatever), when we made the final deal I told him I would take the boat even without putting it in the water and driving it, like i said before...if it floats and starts Ill take it, which was a joke saying unless there's a gaping hole in the thing or the drive is hanging off the back ....I'd take it. I don't know how much more I could have done to constitute a done deal. I did everything that was requested by the seller and agreed upon by both of us. You guys that say cash is king, I guess if an agreement was never reached then so be it but in this case he said it's sold! You guy's can see whats going on here, he obviously reneged on the deal for more money and his buddy's are sticking up for him, Whatever. There will be lots of other boats and I did what I set out to do which is call out a flake for going back on his word. DONE DEAL!

He started at 32k, sold it to me for 24k and sold it out from underneath me for 26k. You need to hear the REAL story before sticking up for him.

Sucks but it is what it is. I’ve missed out on deals in similar situations before. It is frustrating, but in the end it is my fault for not making the deal.. meaning purchase the item.

I sold my aluminum horse trailer years ago but didn't do my homework on how high aluminum went. Agreed at 15 to a guy who takes him daughter all over together, another guy called and offered 18K. I stuck to the 15.

I am not saying that did or did not happen on this deal.

Agreed, not the end of the world and it would have been over by now except I had to explain the real story versus what he was telling Phil. Like I said, I did everything he wanted to do to tie up the deal. Just responded on here to defend myself and reputation which means more to me than some people obviously.

this is the best approach to selling items. You make it clear from on-set, to all interested buyers that it's cash as is where it is.

The seller in this case (Bobby), didn't present this deal in that manner (apparently) and posted to the world on a public forum the boat was sold...before receiving cash...then reneged on it.

We have FOX, ABC, and CNN reporting, we need CBS to come in and give a forth person version.

I have the texts, not what i'm hearing, bottom line was you weren't 100% sure, however you want to spin it go ahead, the boat is sold and you are right, DONE DEAL!! Like I said before, guess text get read/interpreted differently.

When you state "sold to OG member" in the ad, there's no going back from that, plain & simple.

He did, he douched.

A lot of things could have/should have happened differently, a lot of opinions here when just 3 of us have seen all the texts, doesn't justify a call out and threat thread.

Honestly, it doesn't seem like it was communicated to Marko. Sounds like he ASSUMED Marko was unsure so he went after the second offer. I don't see any of this whole situation happening had the 2 of them truly discussed any possible apprehension your step-son was feeling about Markos intensions.

Not sure how many times I need to type it, but Marko clearly texted he wasn't 100% that he wanted the boat, he can spin his version of, if it floats then yada yada but his uncertainty is what wrecked the deal, nothing more.

Chalk it up to being a young gun, but you don't post that and then back out.

Not the end of the world, but backing up your girl's cub can be detrimental to your reputation. You'll have to weigh the benefits. :D
