.., I think it is something you have to squeeze out of your insurance company… I tried to get it from Allstate… But was set up way too wrong???… probably should try it again as things have changed…

.., you are required to give them your policy limits… or I guess I should say your insurance company is required to give them your policy limits… 90% of the time the other party settles for your policy limits…
In my experience this is not true.

When my daughter was in an accident Geico called and asked if I wanted to give my limits to the other party's atty, I said do I have to? She said NO!

I can't think of one reason you would want to?

Here is an insurance story.

When I was in high school, I was told by my Dad not to let anybody drive my car. (Actually my Dad’s car, because it’s in his name) Of course, like a dumbass, I let my best friend take my car. Mainly because I wanted some alone time with this girl, so I wanted him to go somewhere else. Lol Oh what a mistake. One that cost my father dearly.

My friend ran into a girl riding a moped, and she had to have her leg amputated. My Dad was smart enough to get his own attorney, along with his insurance company’s attorney. As a Strategic Move, my Dad, through his attorneys advice, demanded that his insurance pay full policy limits. My Dad was well insured. But….. My friends Dad’s insurance also paid policy limits.

All in all, I cost my Dad 50k out of his pocket, back in 1980. Mainly legal bills. I have always been remorseful of what happened. I was able to use the story above to instill in my daughter why I didn’t want her to lend her car out. The above story is also why I am over insured on everything I own. It’s also a real life story that happened to my family when I was in high school. Live and learn

Just an FYI, my daughter was involved in an at-fault minor accident with SF and they did not drop us. As others have said, get an umbrella, which will require injury limits to be maxed out.

On transferring assets - the lookback period in Cali is 2-years or 2-years from the time of discovery. And normally, a trust is not an asset protection tool.

Good luck with it, sounds like you got it handled.

… I should have qualified what I posted… that was in the 80s…

My claims agent reached out to me today. SF intends to pay out my total insured amount. (at that time) $75,000 for this accident. This blows my mind.
Here is where things are getting REAL sticky!
The other party's attorney submitted a Settlement Demand Letter. In this letter, they are requesting a ton of information including where my son was heading to and from, where he works, how much he makes, and even asks if he was wearing his work uniform. The last part is what has me worked up.... Bank account name, number and balance of the insured. When I asked who the insured is, guess what the answer was... Yep, that's me.
I have no intentions of releasing that information, so I guess it is time to find a defense attorney.

Did the demand go directly to you or through SF? Let your insurance deal with it. If SF pays out the case is over as long as the opposing attorney signs off.

Unless that demand letter was sent verified to you directly, don’t action it. If the other parties attorney signs off on payment, issue is DOA. Unless other party filed a civil claim against you.

This was sent to me through my insurance. I told them to assign an attorney because I will not be providing my bank account information to anyone. I am waiting for a call back.

- There is no excess/umbrella insurance
- Not driving in course or scope of employment

What firm is representing the other party?

I asked my claims agent if he was aware that this is a BS claim. He said yes, but this attorney has a very aggressive demand letter, over 100 pages, and the other party has somehow managed to come up with over $35k in doctor bills including spinal specialists. Again, this all for my son hitting their stopped car at speeds under 10mph. Mind blowing what people will do.

Guess they have no health insurance. That company should be the one contracting SF not the lawyer.

Total BS.

Appears to be a single attorney firm with a few staff.

Probably doesn't have the bandwidth to actually follow through with a lawsuit unless a doctor diagnosed them with more serious injuries.

Most of the demands threaten a bunch of action but unless the injuries are severe enough and the money is available to go after... it's not worth the time to litigate.

I got sued one time for $1M for rolling into a guy at a red light. All the same questions were requested as above. My Allstate agent at the time kept me pretty calm. I think they settled 24 months later for $4600 in chiropractor receipts. Everyone knows the scams now. They are just looking for a settlement and want to scare you into a higher agreed upon number.
