Anyone know of a good medical malpractice/personal injury attorney? Would like to run a case by them.

Anyone been down that road and have any first hand knowledge that they can share?

Unless you have a dead baby or you come out missing a perfectly good body part there's not much the legal world will take on. The agreements that you sign before services protect the doctors, not you. Call around and see if anyone will take your case. Most big firms have a web site where you can fill out an enquire and they will call you back if they are interested.

My sister was killed by a medical error in Kansas and it was a pretty much a settled out of court case instantly once an attorney was retained.

But I guess that would be more along the lines of wrongful death?

They're tough and California has a cap on the some of the damages. They're also expensive due to the need for experts, so not many attorneys handle them.

I once thought that I had a good referral for a med-mal attorney. He said "Oh no, that's actually just a risk of that procedure. That case won't go anywhere."

If you want to DM me some of the basic facts, I'll run it past one of the attorneys I know that handles med-mal.

If you have health insurance in california you most likely have to go through binding arbitration first. It’s in the fine print when you sign the enrollment forms for all major carriers.

I'm sorry you lost your sister. I lost my sister to medical delays because of covid. The highest level of neglect until it was to late. When she final got to a surgeon, he came to us and said he wasn't going to operate. She would be dead within 24 hours regardless of what he did. We had to go tell her what was going to happen. She was able to call her friends and say goodbye. Some stopped by to visit. She ate some dinner and said she wanted to rest her eye for a minute. We turned down the lights and she was gone in 10 minutes. I put together an OJ style legal team that turned over every rock. Bottom line was, people making covid rules that had no clue what they where doing but, we all had to live and die by it. There was a settlement that didn't cover all expenses.

That's why they are medical practices.. Practice is supposed to make perfect. Just like lawyers practice law. I practice hot rod repair. Hope it works out for you.

So, So sorry about your sister. There were a lot of similar stories that occurred during covid. I'm an example of what happens when you have symptom's but the doctors were not seeing patients. A simple PET scan would have shown the cancer in my body 7 months before the need to remove my right kidney and 6 pound tumor. I'm now living with the long term, hopefully long term effects. It was a shitty time for medicine and those people that needed care.

I started going down this road when the surgeon sewed my toe back on but the x-rays a week later alerted me to the fact that he failed to reattach the bone, which died and killed the toe, requiring that it be amputated.

The attorneys I spoke with explained that CA caps malpractice awards at $250K…and the only ones who get that are people that end up paralyzed or something major like that.

They went on to explain that using that scale, my toe was worth about $5K to the jury, and my fees would likely exceed that.

I have two attorneys you can talk to. One is the settlement guy and the other is bat shit crazy but only take on contingency cases that he knows will get to trial. He’s good. Real good and has put together some really good judgments for people I referred.
