Why was Gary not charged with assault? Kidnapping etc? That video was wild to watch. I can’t believe they let that old prick skate with a disorderly. If that was my kid and I saw the dash cam and the recording I’d be on the phone with the cop / da Saying we are pressing every charge we can get.. Gary needs to learn some serious lessons

That’s exactly the procedure.
Plead not guilty and have your day in court.
I believe I read that the citation was dismissed for the 22 yo.

As far as the other stuff that’ll likely be determined.
Cops don’t typically make felony arrests at public arguments.
They might arrest people on certain charges to hold them, then let the DA or magistrate figure it out.
The charges you are describing are mixing up misdemeanors and felony charges,
A Park City cop is not going make a felony arrest on a Park City taxpayer over a car/ bicycle argument no matter what.
It will be interesting for sure to see how this develops though.
It’ll likely come down to who has the bigger wallet in Park City, Gary or the young man’s Daddy.
The “kid” is not a kid, he’s 22 yo.

I worked for a construction company in Shawnee, Ks. in the early 90’s.

They had an old boom tuck I would use to change the engines out in the field on their Cat equipment.
It had a Big Cam Cummins in it and the exhaust exited right below the right rear corner of the bed at about 3 1/2 feet above the road straight out the side.
It was “turned“ way up on the fuel settings and if you stuffed it into a high gear and caused the engine to lug you could put out enough smoke to completely disappear the cars behind you.

One day I was driving up Midland Drive to the shop and I got behind a cyclist that was riding in the center of the lane of this two lane road. I started to go around him and just as I did a car pulled out coming towards me in the oncoming lane. I ducked back in behind the cyclist until the car passed. Just as I started around the cyclist for the second time he pulled a can out and threw it at the windshield of the truck hitting it and cracking it. Then he proceeds to flip my off and scream at me.
I went on around him at about 20 MPH and slipped the truck into 10th gear. I flat footed it just as the exhaust was lined up with the back of the bike. As the smoke poured out I could see he head and the handlebars and that was it. He actually started picking up speed and keeping pace with the truck. I kept it even with him for about 1/8 mile or so and finally he disappeared into the dark….

The shop was about 2 miles ahead and just as I quit spewing ”coal” into the first heaven one of the owners pulled off a side road and in behind me. We pulled into the yard together and when we both exited our vehicles I called him over and told him the whole story and showed him the cracked window.
About 1 minute later the cyclist pulled in. You couldn’t mistake him because he looked like the kids pictures from the early 1900’s after working in the coal mine all day. The owner told me to go in the shop. As the cyclist rolled up I could hear him going absolutely bat shit crazy but he reversed the story and said I smoked him out first and then he threw the can at me. The owner asked him how did he manage to hit the front windshield from the back right side corner of the truck? I’m not sure what the owner said to him after that but the cyclist went on the way.

The owner never said a word to me about it except to ask if I got the glass company coming out to change the windshield.

I can still see the look on the cyclist face as he disappeared into the cloud……

How does paying a ticket negate further charges?
Traffic rollers do not determine charges. They issue tickets and make arrests.
Paying a misdemeanor citation in no way erases the possibility of further charges based on emerging evidence.
It’s a little alarming the lack of understanding of our judicial system being displayed.

I drive through Provo, Hebert, Park City about 20 times a year.
This Karen is the poster boi for Park City entitled activist.
In this case he was on a bicycle, but he’d be the same asshole whether he was jogging (like most of them there), or buying a smoothie at the Whole Foods stand.
It really bothers me the animosity being displayed towards bike riders.
Not long ago the membership was ready to behead a guy for running over that cop on his bike and killing the cop.
Why now does the bike rider deserve vigilante Justice simply for being on a bike?
The dude is an asshole, and probably is up the ass of his neighbors and basically everyone he crosses paths with. It has very little to do with his bicycle.


When I lived in Havasu I’d ride my bike about 3-5 times a week. It was about 25 miles to ride from my house to the skate park then around the island a couple times then back to N Palo.
I can not recall a single ride where some douchebag did not pull into the crosswalk against the signal, or just totally ignore me and turn right on red in disregard of any rules or signals or my presence.
Once I actually got knocked down by a truck turning on red when I was almost all the way across.
A little harder and he would have put me right onto 95 and flowing traffic.
So to me, it’s disheartening seeing this hate on bike riders all because some Park City CA transplant idiot puts on a show in his spandex.

Oh…and rolling coal is a moving violation in most places, and can escalate charges if it causes a wreck or injury.

Basically, a citizens arrest, citizen is making the complaint. Law-enforcement is writing the citation.

I'll sum it up with one California Vehicle Code section that majority of cyclists refuse to obey.

California Vehicle Code section 21202(a) - Any person operating a bicycle upon a roadway at a speed less than the normal speed of traffic moving in the same direction at that time shall ride as close as practicable to the right-hand curb or edge of the roadway except under any of the following situations: passing a pedestrian, another cyclist moving in the same direction, making a left turn, etc.

A lot of the true assholes bring the hatred on themselves. They act as if they own the road and ride in a manner that utilizes the entire lane because they think they are allowed to. That's not the case, which is why motorists despise them. In our area, guys "Hog" the lane, forcing vehicles to drive at the same exact slow-ass speed because there isn't enough room to pass them. This is in L.A., where everyone is in a hurry, so of course people get pissed. Then, the ill-informed cyclist gets pissed because motorists are getting impatient or pass them too close for their comfort. So of course tensions rise and anger goes through the roof.

Ask 100 bicyclists and 99 of them believe they've "the same rights and responsibilities as drivers."

(2) the person is preparing to turn left at an intersection or onto a private road or driveway;
(3) a condition on or of the roadway, including a fixed or moving object, parked or moving vehicle, pedestrian, animal, or surface hazard prevents the person from safely riding next to the right curb or edge of the roadway; or
(4) the person is operating a bicycle in an outside lane that is:
(A) less than 14 feet in width and does not have a designated bicycle lane adjacent to that lane; or
(B) too narrow for a bicycle and a motor vehicle to safely travel side by side.
(b) A person operating a bicycle on a one-way roadway with two or more marked traffic lanes may ride as near as practicable to the left curb or edge of the roadway.
(c) Persons operating bicycles on a roadway may ride two abreast. Persons riding two abreast on a laned roadway shall ride in a single lane. Persons riding two abreast may not impede the normal and reasonable flow of traffic on the roadway. Persons may not ride more than two abreast unless they are riding on a part of a roadway set aside for the exclusive operation of bicycles.
