Unfortunately he’s likely gonna be in trouble due to that last shot.
Even in texas you generally can’t execute a person.
Meaning shooting him after the threat is stopped.

He was ok until he walked over and skull capped the bad guy. Then again, it is Texas so…

Here’s a good example from John Correia’s excellent channel “Active Self Protection”
I highly recommend subscribing to this channel.

This encounter is from isreal but it’s a great example of going from defender to murder.

Haha The best video I've ever seen. He won't do that again the bad guy.
Correia breaks it down in this mornings new video.
Worth the watch, as is all his stuff.

That and he shot the guy in the back, like what was said in the other thread "You dropped something" cap him when he turns around, also he left the scene.

Personally I think it's a clean shoot, good job👍👍

Especially that final shot to the head to seal the deal in case the first half dozen or so had only wounded him. 👍🥴

Yeah all his shots were in the guys back.
I typed that as well, but I deleted it once I watched Correia’s assessment, as he did point out that texas has state statutes that allow for deadly force to stop an armed robber, and the bad guy was still brandishing when the shots started.
So, in this case, the shots in the back will probably not matter, it was the first real opportunity the good guy had to draw outside of the drop, which was the best part of his action.
But as John says to him: “if you’re watching this video, GET A LAWYER before going to the police!”

Most other places that last shot for sure would get him a manslaughter charge, but then again, unless he’s a trained Leo he is held to a lesser standard of conduct.

People may think this is nitpicking, it isn’t.
It all matters.
If you carry, you’d better have insurance, and you’d better take ALL the training you can, especially the legal aspects.
If you violate the law in the act of self defense your insurance company may not be of help, especially if you did not complete, or you lied about, the classes required.
No insurance company will help you if you engage in, or initiate vigilante actions. Learn the difference before it happens.

This guy should be ok other than that kill shot.
His lawyer will have to dance for that one.
But as is pointed out in the assessment vid, “you put the quarter in the jukebox, now you hear the music”.
The entire encounter was initiated by the robber, he took the room temperature challenge for his efforts.

The only thing I see that might get him in trouble in today's society is after the gun falls out of the hands of the suspect on the ground. That guy needs a good Attorney to help explain those last shots.
He needs to pray that he's in a county with a DA who isn't woke.

Especially since he also had the bad guys gun in his hand when he delivered the head shot.
That’s execution.
Might not matter depending on the DA?
I think it’s kind of funny that all the costumers left before the cops posted. 😱

We have Civil Immunity in Texas.
If it’s a legal shoot then the shooter is immune from civil liability 👍
It should be like that nationwide, if you were injured or killed while committing a crime then you or you family have no rights to a civil lawsuit.

OJ did it, we all know that but he was found not guilty, he should not have been sued in a civil court

I was thinking the same thing. I've been in some local taco shops that it wouldn't suprise me if the had a "cleaner" on call for all the cartel shit that goes on there. Not even hiding all the MalVerde statues and other trafficker memorabilia.

Here's my take on this. Even though the good guy took a gun away from the perpetrator, the hero didn't know if he had another one or not. Also, we don't know whether or not the assailant would have survived the first several shots without the final one to the dome, so that may be a moot point. Lastly, per the ASP video, around 10:20, John mentions the DA is on record saying it was a “justified conduct”.

Not knowing could actually work against him.?
And it was 8 shots before the skull cap.
But John is usually right, it’s his profession after all, and he thinks the last shot might be tricky to explain but not impossible to overcome, especially due to locale.

I feel like if that were me in the moment I would rather be safe than sorry by making sure the assailant is good and dead. I think we all agree the hero would have a much more difficult battle in commifornia than Texas and, since the DA already took the position of justifiable I hope and pray nothing ever happens to said hero. As John mention's, it's probably best to lawyer up.

I’m not convinced the “hero” isn’t a killer in his own right.
He didn’t look too upset after executing the robber.
And he fled.
We’ll see, but I won’t be surprised if he’s less than a stellar citizen.
Just a hunch really.
Oh, and he had no problem emptying the dead guys pockets
How many here could do that? How many here have even touched a dead person that they just killed?

So, I hope the good guy keeps his mouth shut, head down. He has NOTHING to gain by coming forward. Good shoot. He needs to lawyer up now, in case it comes out later. My formal training taught me to say nothing, other than asking for representation. I don’t know, I don’t remember are the only things to say.

“Lawyer”
It’ll be interesting to see if he steps up.
My feeling is he won’t because he isn’t the Saint we assume him to be?
Of course, it’s just my opinion and for all I know he could be legit.

I have the same feelings and believe that's why he fled. Still a hero well, sort of anyway. And yeah, reaching into the dead guys pockets is definitely next level creepy.

The shooter's general demeanor and actions suggest this wasnt his first rodeo He didnt seem paniced , betting he's a local enforcer , maybe a "mob guy" Reminds me of a scene from Pulp Fiction
I agree totally.
I keep seeing Samuel Jackson demanding his wallet back…

Well, he’s not out robbing people that are eating dinner is he? You don’t think that maybe people have been in situations were they have killed people, or been around dead bodies that were justified?

I know for an absolute fact that “people” have been.
Never said they haven’t.
I asked how many here have? (Rhetorically)

I’m saying I’m not gonna call the guy a hero just because he got the drop (from behind) on a wanna be thug.
For all we know the “good guy” just wanted a burrito before his next home invasion.

I hear you. But let's talk about the obvious. He shoots him multiple times, pauses, then puts a last one directly to his head (at least that is what it looks like). He then walks around a bit, goes through the guys pockets, and "returns" the money (at least that is what it looks like). People react differently, and I get that, but what raises the biggest question for me is really this simple.;

In a situation where it really does appear he was justified, why did he leave? It's a kin to celebrating one gang member killing another gang member and trying to put him up on pedestal.

Who knows what that guy is all about, but as mentioned numerous times now, it doesn't appear to me like he was uncomfortable at all in that situation which will raise a ton of questions.
