Help - Can Am Dealer rolled my X3

So the dealer replaced a wire harness on my Can Am and then took my car for a test run in the dirt and rolled the car.
My car was very clean, had never been rolled, or really even driven that hard.
They say they will replace everything cosmetic, and anything else I want replaced.
I understand, replacing plastics, etc is easy. How do I know the frame/cage is fine? How do I know the motor is fine.
ANY and ADVICE is appreciated, please.

Well now... Something similar happen to a friends car where the dealer crashed it and fixed it without tell them... (they found a reciept in the visor from the bodyshop).

It was a few year older car and dealer bought it from them and gave them a killer deal on a NEW car.
I do not know what year your SXS is or if you owe money but they need to make it RIGHT.

It's a 2020. But like I said, very clean, perfectly maintained, tons of aftermarket parts.

Dealers all across America have been buying hellcat challengers thanx to the lot boys that just wanted to FEEL the power !! I have a card fuel depot a few properties down from my shop and constantly see the lot boys getting it on in some customers car, is it wrong that I want to see carnage ??

Thank God I worked at a dealer in the 90s...stuff wasn't fast enough at Ford to be an issue. My crap was faster 🤣

They are required by law to fix all damage while under their care, nothing more. If you are willing to work with them they will most likely bend over to make you happy. But a new car and the threat of a lawyer may put them in fuck you mode. You have them by the nuts, don't get too greedy or they will just let the lawyers handle it and you won't have a car for a while. JMHO as a GM who has been through this a handful of times.

If they have to turn it into insurance they may total it, then you get market value just like any other insurance pay out. Sometimes hardball is the way to go, sometimes it is not. The actual damage is the most important thing to determine your approach.

Prepare a fair itemized Bill showing all the upgrades you did the car including the purchase agreement. Give it a fair depreciation value for the four years that you've owned it. Tell them you're interested in trading it in on a newer model and that is the lowest trade in value you will be willing to accept on a new unit. No need for threats, no need for lawyers, handle it like a true businessman because I can guarantee you the manager or owner you're dealing with is just as angry about what happened as you are. Employees suck nowadays.

Never been in that situation but I’m sure they ain’t going to give you a new car over this.

I’d see them letting insurance companies work it out to repair it etc.

I like the extended warranty idea, and fix it perfect...then whatever consumables they need, a handful to keep on the shelf, belts? Axles maybe? Stuff they can bury, but you and I may hate paying for.

I am pretty sure if you threaten "lawyer" they will just hand the case off to their lawyer and hold you up in court for however long while you pay lawyer fees....is it worth it to you? I agree with everyone above, fix it as clean as it was when you dropped it off, and ask for some kind of extras like extended warranty, free periodic inspections, oil changes, whatever else you can get them to agree to...

They will most likely give you a good trade value if it allows them to move some new inventory, depending on how many they have in stock.

You need a lawyer if you want a new car out of this
-1 the dealer is liable for all the damage
2 the person driving this car was not professional in his duty of work .Cars in for electrical work and he took it out for a joy ride . He is at fault.

Both need to named in the lawsuit.

This dealership did you wrong
So what’s the name of this place

If you just want a replacement car
This is a no brainer , you will get one

It will cost them 5x the amount of replacing the vehicle if they want to fight it. The last thing a dealer wants is the bad press.

They can fight all they want. They will still lose in the end. A plaintiffs attorney will take it on contingency as its a slam dunk.

The comment about not feeling secure to putting your wife/kids in it after it was obviously driven in a manner you have never put it through could provoke them to step up.🤷‍♂️
Also, was it a true rollover or just kinda laid over on its side.
If the latter, let 'em fix it to your satisfaction and get some perks like maintenance parts(belts/filters, etc.) and maybe a few inspections to to make sure there isn't a cracked weld ghost lurking.

As a bsuiness owner the word lawyer does not even bother me anymore... it just shuts me down. I am more than happy to take care of customers 100%. Make it more than right but if I even hear the word lawyer I'm done because people who say lawyer will never be happy until I am unhappy not equal.

Like others said above, if you explain you baby your stuff and can never be happy knowing it was damaged by someone else I would bet they will give you 120% of the value in trade in and a deal on a new one but no one is giving you a new car.

If it's in your possession, I'd measure everything out, and see if it's square. If it's leaning, I'd be raising hell.

The biggest damage that you can see is the roof rack.
Once, again I know they can replace the rack, and other plastic shit and make it look nice.

That looks like just a flop but pictures flatten out a lot of shit and don’t always convey the actual reality.

I’d have them make it new again and work out a free service plan or warranty plan. That’s if you’ll continue to have them service the car in the future.

If you want to tie up money and litigation with lawyers it could take forever to resolve and way more money than your time without your car will allow.

Why do you have to test drive an electrical issue at all. They were out hammering your car at your expense.
Don't know what their answer is, but with some "intermittent" gremlins you have to drive it like the owner. Had a guy tell me his truck over heats when his wife drives. I drove that thing like I stole it, never showed anything off kilter.
He neglected to tell me his wife only drove the truck to horse events, with a massive Sooner, horse Hilton..and she passed me coming up I-17!

Tell them they can keep this car a fix it for themselves. Then sell it as a trade in. You will get around 20k in trade with ALL the stuff left on.

Then you get a new one.

So their actual cost to this is around 20k assuming the new one is 40k.

If they try and fix yours you can assume
Cage is junk including rack
Plastics junk
A-arms and suspension parts are comprised due to side loads.

All the parts and labor and they are already at 10k.

You guys saying a new car won't happen i disagree.
Plus down time. You MUST have 3 trips planned at least that will be canceled due to their negligence.
Plus social media...if the try and fuck you over then it's game on.

I don't see how they CANT replace it

This.

The one thing I would request (an earnest sit down meeting run at room temperature is required) is removal of bodywork, seats, or whatever so access is gained to the cage attachment points and the frame in general. Concern about unseen damage is legitimate and a safety issue.

Easily visible damage will be seen, but they need to look for cracked and spalling powdercoat on joints and gussets too. That will indicate stress was applied that could have weakened the parts.

You're going to get much further with a measured approach that itemizes your misgivings about the damage. Hysterics and unreasonable demands will just cause the dealer to retreat into his shell and make things difficult. @Todd Mohr is a car dealer, and I think his advice is the most valuable in this thread.
