I’m going boating but later on I’ll share a similar story, but I knew the seller and his wife. Unbelievable how people will treat others, Marko this just sucks.

Well first come first serve and the guy had cash over check and gave my brother full asking price no questions asked. It is what it is I’m not sticking up for him but I’ve been in the same situation

Technically, if you offered a price and he accepted, especially in some written form like email or text, you have a contract. Offer and Acceptance.

Based upon the facts you outlined in your post, it looks pretty much like a contract. They will say it was not, but just a negotiation.

So you can sue him for specific performance or alternatively for your damages and if you win, because it is a contract claim, he would have to pay your reasonable legal fees and costs. The new buyer gets dragged into the litigation also. Oh what fun.

Economically it is not worth it, but if you are really pissed and have plenty of resources, just sue him and make his life a mess for a while. The law frowns upon physically beating people up now days, but they don’t frown on drowning an opponent in legal fees.

So you don't consider the text photo of Marko's cashiers check made out to your brother as "first come"? It's not like Marko just said he'll show up with the money. Getting a cashiers check pretty much indicates he has funds and has committed to the purchase.

Sounds to me like your brother just got a better offer and decide to blow off this Marko guy's deal for a few extra bucks.

I have the same situation going on now. I have a motorcycle for sale on another forum. I have a buyer that is committed to come up next Saturday and buy it. Got a PM from another member offering more money via overnighting a check to me. I told him if the other guy doesn't show then he is next in line. I already committed to the first guy (first guy will bring cash when he gets here).
