What's the law for a minor getting caught carrying a hunting knife in his car on a school campus after damaging my son's tires in the school parking lot? My local LE isn't even citing him for vandalism even after the kid admitted it.

That's sucks Ruben! We should kick his ass!

He just wrote a long apology letter to Justin via Facebook. My son isn't the forgiving type. We already had one parent come to our house tonight from a kid that we didn't even know was involved with this.

I'm tired of all this HS shit! Several people have contacted Justin today and told him that this kid has been talking about doing something to him for about a week.

I'm taking this as a threat to my son. LE searched his car on campus and found the knife, he admitted to doing this, and yet they didn't even write him a citation. The school is next - their treating this with a slap in the wrist for this kid. My wife and I are meeting with the Principal and Asst Principal tomorrow to vent our frustration over this.

It has been a long time, but I think that the knife is going to be a local ordinance violation, or some section of the Education Code that I cannot remember..
If the suspect is under 18, the cop CAN cite for 594 P.C. vandalism (misdemeanor) even tho the crime did not occur in his presence.
That is not the case with adults, cops must see it happen to issue cite/arrest..or have a warrant, etc, but this is the general rule...
The suspect has a problem, I would push for the cite and let him be referred to the Juvenile Probation Dept., and get him on the hook for restitution. Schools up here don't usualy let stuff like this slide.

Wow Ruben you guys have had your share of problems this year. Really pisses me off to hear that the cops won't do anything. Kid needs to get his ass handed to him. If I had done something like that as a kid I would not have seen the light of day for weeks.

Good luck and hopefully the parents wills step up and take responsibility for their kid's actions.

I'll look it up tomorrow. I believe the knife on school grounds may be a felony. Depends on the verbage and whether they consider a parking lot to actually be on the school grounds for the sake of the code.

In cali I think the total for felony vandalism raised along with the grand theft total to somewhere around 900 total damage or loss value.

Thanks - that's the direction I've been considering. The school will not get involved with any of this - I'll have to pursue through our local Sheriff's.

great idea ... you gotta try and step in before the potential of something very bad happens.

you hear it all the time on the news when something bad and tragic happens ... research begins on the person who did the bad thing and they realize that there was history about the person.

try and stop it before it escalates into something much bigger and/or worse

Refer the shool resource officer / or handleing officer to Penal Code 626.10 for the knife on campus and PC 594 for the tires.........will depend on cost of tires if its a felony vandalism..........if officer won't deal with it, move up the ladder. School should also immediately suspend/expel the kid......good luck

Please don't take this the wrong way but have your son and this kid been enemies and this was retaliation or was this just a blatant asshole move on the kid? Either way if the school won't do anything than get the sheriffs involved. Tires ain't cheap! But more importantly you don't want stuff getting out of hand

The Sheriff deputy told me that it would be up to us if we wanted to press charges. He felt that the student showed a lot of remorse. I think the kid is sorry that he got caught.

They're not friends - my son was totally surprised that this kid did this. I know my son isn't perfect, but he didn't do anything to provoke this. The kid admitted that he didn't like my son. I wouldn't pursue this more than I am if it was just a random act or the kid just spontaneously started a fight with my son, but he thought all of this out.

I would accept that, and let it go.. but I think I would insist the the money is either earned / worked off by the kid.

Playing devils advocate here but is the car technically private property in this case? Maybe it happened on a lot that they don't own?

I dunno how old you are Dave but when I was in high school a knife on school property whether found in your locker,backpack was a big deal, they viewed it as a weapon. I don't care but with some of the crazy stuff kids do without thinking when they don't like somebody can get bad . Not saying THIS particular kid would but I wouldn't take anything for granted after columbine if I were them.... Just my .02

Hope this thread doesn't go sideways just getting opinions on what my concern would be if it were me...

Any knife, including a pocket knife, is a violation of school ed code. Any knife over 2 1/2 inches long is a penal code violation, and the parking lot is considered part of the campus.

My mom worked for our schools districts superintendent for about 25 yrs and I believe having a knife on campus was mandatory expulsion, no if ands or buts.. I'll try and get a hold of her just to see how different districts are.

Hope it all works out the way you want..... I think I would want more then just the tires replaced....the kid needs some consequences for is actions.

i would take the money for the tires, and try to tell your son to avoid the situation i know when i was in highschool if this would have happened the kid would have been kicked out no doubt we got 6 hours of detention if our cell phones left our cars we were not even suppossed to have them in our lockers and i also know how i was im sure a large group of us would have found this little shit outside of school and gave him a good ole' fashioned ass kicking

On a serious note, have you spoken with this kid? Sometimes kids like this need a break, maybe it will change his direction in life when he sees how an adult may show some compassion.

Bad deal all around and it sucks that kids out there can be so cruel.
