He had been married only a couple weeks so the rage is understandable.

He found out BJ's and hanging out with the boys was all over for him.

I feel badly for her. She probably had no idea the guy was a violent hothead.

I didn't see the gun get pointed, just brandished. That said, I don't know if he has a duty to have it pointed at him in order to act. Angry guy with gun in hand comes over to confront, man that's a tough split second decision. On the outside looking in, I don't think it was going to escalate. But in the shooter's position? Man, that's a different story.
If he was a cop by most jurisdictions he would probably be cleared without charges or tried and acquitted based on the circumstances and facts as he understood them at the time, not necessarily the actual circumstances as he came to understand them after the fact. Graham v Connor, 1984:

"The 'reasonableness' of a particular use of force must be judged from the perspective of a reasonable officer on the scene, rather than with the 20/20 vision of hindsight."

So if he can convince the police or a prosecutor or a jury that he believed that the dead guy had a gun pointed at him based upon the guy having a gun in his right hand, dropping his right hand from sight and the switching the gun to his left hand before rapidly bringing his right hand back up and pointing it at the driver I think he may get away with only being financially ruined and possibly feeling terrible remorse, but I barely graduated from high school so I may be completely wrong.

I don't think the guy in the truck has to convince anyone of anything - police, prosecutor, criminal or civil jury.
He should be very thankful this was caught on a dashcam though.
Reading the YouTube comments; apparently this wasn't the dead guy's first roadrage attack.

Indiana self defense statute below seems pretty cut and dry to me.

(c) A person is justified in using reasonable force against any other person to protect the person or a third person from what the person reasonably believes to be the imminent use of unlawful force. However, a person:

(1) is justified in using deadly force; and

(2) does not have a duty to retreat;

if the person reasonably believes that that force is necessary to prevent serious bodily injury to the person or a third person...


(d) A person:

(1) is justified in using reasonable force, including deadly force, against any other person; and

(2) does not have a duty to retreat;

if the person reasonably believes that the force is necessary to prevent or terminate the other person's unlawful entry of or attack on the person's dwelling, curtilage, or occupied motor vehicle

It’s Indiana, everyone has a gun on their person. You don’t need a permit to conceal carry so carry they do. Indy has a lot of violent crime too. Not surprised at all he didn’t get charged.
I have a family member that’s the sweetest little lady you’ve ever seen and she keeps the Governor in her car. lol
Lived in Indiana as a teen in farm country, every vehicle had guns in them.

Not a complete road rage incident but I damn near got out of my rig. Homeless guy I encountered entering my tract.... I am pulling into the tract and he grabs a Rick, throws it and hits my quarter panel. I coach softball so I always have gear with me. I put it in park, grab my bat to start to hammer on this guy. I get out and realize there are ring cameras everywhere and I would be charged with aggravated assault. I get back in and drive off and tell the police
A kid I actually coached is an HB cop now and he arrested him. Glad I made that choice

what i posted earlier was yes rager switched the gun to left hand but there was no way shooter could see it.he was watching right hand arm and sawit lift after guy punched the door.At this time he fired and was 100 percent justified.thers no ifs or whats in this case.

When you come out with a gun in hand expect resistance do this to a cop your getting shot as you walk out the car although they may drop the guy as he walked out armed they will say it was a good shoot but if a civilian did the exact same it may get looked at deeper and thats the sad truth.Being the guy in truck waited this long shows he was patient or held back til it was game on.

Really? Think they ever had a disagreement? Possibly under the influence or quite intoxicated? I'd bet she'd seen his anger or rage before. A guy that enraged didn't just happen that time.
Apparently, he's not a very good gambler. He gambled, he lost. Sad deal.

Got into a pretty wild road rage a few years ago, looked in my mirror and hoodrat Beemer Boy was 2 inches from my bumper in heavy traffic, I always relinquish the left lane when someone is moving faster than me, heavy traffic meant I had to speed up and try and find a gap in the right lane to let him by.

Swerving side to side and holding his horn steady I said Fuck it you're going to stay there a while now bitch, tried to pass me on the shoulder, nope isn't happening.

I shut every gap that came up, my adrenaline was off the charts at this point, decided fuck it enough already, moved out of his way same time an exit on the right came up, looked over through my passenger window with a shit eating grin and saw the barrel of a pistol being waved my way as he exited.

When I got home I realized lives could have changed that day, it's not worth it.

Apparently, he's not a very good gambler. He gambled, he lost. Sad deal.
It's impossible to say. How did he treat his newlywed spouse? His explosion of irrational anger didn't just appear out of nowhere.

But it is tragic. The lives of family members have been irrevocably changed forever. The shooter did what he thought necessary to defend himself in a dangerous situation, and it's almost certain he will deal with terrible emotional consequences for the rest of his life.

Terrible deal all the way around. Full FAFO in effect. If some guys cut me off like that, and got out of the car carrying a gun, he would have fallen much earlier, would not have even given him the chance to approach me. Dumb way to die, just married, just stupid antics.

I drive the speed limit and people here dont like that!

Just this weekend, some jacked up Tacoma ended up following me into a mall parking that I specifically pulled into because I felt like he was following . Sure enough I made a bunch of turns and this kid was still following.

Got me concerned and Im still wondering whats his plan was. I was about to head to police station and he tapped out. Im still clueless what I did.

Driving the speed limit passes people off down there. They think you're trying to slow them down. In the LA area, I never ran into problems with road rage in the mornings, it was 0'dark-thirty, less traffic but still busy at 4:30. The afternoon was always a shit show. Everyone wants to get home, day could have been shit, etc...
I think it's a collective blood pressure thing. Traffic=stress, driving Mach 5 with lighter traffic, also stress.

I live in an area with no freeways, no high paying jobs and a butt load of guns. We don't have too much in the way of road rage up here. Glad you're safe though. Strange times we all live in.

Drivers here are terrible. If you're not driving 20-30 over the speed limit, you might as well stay home. People need to learn to relax and not be in such a hurry all the time. I almost got clipped in the front passenger quarter panel the other day. Dude just decided he needed to be in my lane at that exact spot. Nobody in front of him or me. I was in the middle lane, he on the right.

I agree, I will say that this is one thing that took me by surprise moving here. There is alot of road anger. Maybe its the construction? They are always closing freeways on weekends here. Or the heat? Or just fallout from Covid times?

Just very odd. My Dad just moved from TN and said exact thing before we even had a chance to talk about it. He is like "WTF is wrong with the drivers out here?"
