I'll admit I probably watch too many "legal" movies and series etc so I'm trying to wrap my head around this case , personally I think Penny's training kicked in and Penny stepped up to the task of subduing this guy , Its unfortunate the perp didnt survive that said I doubt Penny got up that day prepared to take a life . So the Judge drops the manslaughter and lets the Negligent Homeside stand ? Looks to me like it was a FAFO monument that ended badly for the bad guy whats the brain trust say

This should never have gone to trial. He was a hero saving people’s lives that day. I only pray that if the corrupt and incompetent NY jury finds him guilty of anything, that Trump pardons him and also makes it so the dirt bag family can’t sue him civilly, which sounds like the dirt bag dad is wanting to do.

If found guilty of anything, this will seal the deal that anyone in New York will not step in to protect, or help people, but instead stands there and watch the criminals kill people. Crappy attitude, but in NY if it’s not your life, it’s not your problem!

Yeah, I see what you're saying. Penny probably just reacted in the moment, doing what he was trained to do, and it’s tough because, like you said, I doubt he woke up thinking he’d end a life that day. It’s a shame the perp didn’t make it, but I think the judge's decision reflects how messy situations like this can be. Dropping manslaughter makes sense if there wasn't direct intent, but leaving negligent homicide stands shows they felt there was some recklessness involved. It's one of those situations where things escalated way too quickly.

Judge sent jurors home for the weekend.

Did a new decision happen after that??

(Neely had an extensive criminal record, including 42 arrests) that sentence right there should have prevented this from going to trial. Just what we need, make everyone afraid of helping to contain an out of control person.

42 arrests?? Neely should not have been breathing or at least not out on the streets. Just like poor old George Floyd. If the god damn justice system would do their jobs in the first place, we wouldn't be where we are at now. If the rap sheet is more than one page, you have used up your chances and should be terminated for the betterment of society. Sorry 3-4 chances are enough. If they can't figure it out by then, they never will.

My guess is that there was a good number of holdouts on the manslaughter charge, otherwise the judge wouldn’t have dropped it. Hopefully that’ll be the case on the negligent homicide.

Yep! The dude was struggling all the way up to the point where he passed out. If he were to release him prior to pass out, he'd of got up and continued his nonsense.

I think it is like George Floyd. I saw some video of Penny talking to detectives, this is before the criminal died, Penny was showing the officer it was a hold across the chest and not the neck. He was trying to subsue but not harm the guy.

The coroner looked at video and used it in her findings. My guess, is like floyd, that he had drugs in his system and that is the real cause of death.

It’s insane to me that these people that support this prosecutors behavior/charges are the same people to advocate for nationalized healthcare or think the government can do it better than its citizens.
