At the end of all of this I don’t have any “great revelations”… just a solid moral compass and if you don’t understand that I can’t explain it to you.I'm still waiting for some kind of shocking revelations from @JDub24 regarding this whole thing, but in the meantime, here is what I've been doing in these incidents occurring California over the last couple decades.
California looks at Domestic Violence in a couple different ways. The most common penal codes we utilize are Felony 273.5, Misdemeanor 243(e)(1), or Non-Criminal Domestic Violence. Any cop that I've ever worked with that actually gets off training is taught to evaluate the entire scenario before jumping to conclusions based on the physical appearance of the involved party's. In this case, you have a large man who is known to have trained (far from making him a professional fighter unless I too am considered a professional fighter) and works in the MMA world, and you have his wife who (unknown MMA abilities, don't really care) is of much smaller stature.
All we have from our nice cushy seats to evaluate this is a high quality completely clear videoshows them in some kind of interaction, she hits/slaps him, he hits/slaps her, she appears to be being held back as he is standing there and starts to turn his back to the camera. She hits/slaps him again, and he hits/slaps her again. If you keep watching she appears to be up giving him a hug shortly after (no idea how much editing is going on in that video).
So, If I'm the cop showing up to that, I'm doing a few things real quick;
-Examine each of them for injuries. (Visible injuries is Felony 273.5, No visible injuries can still be 273.5 depending on the circumstances, but to keep it simple generally no injuries will be 243(e)(1). Heated arguments where violence is likely to occurred, multiple occurrences in the past, threats but do not meet 422 etc... get documented as Non-Criminal Domestic Violence which is far more historical tracking and CYA for all involved than anything else. )
-Ask both of them for their version of what happened.
-If available, watch whatever video was there and see if there were any witnesses.
Once all that's done, instead of just assuming the male, or larger party, is the one guilty, you have to weigh everything and determine who was the dominate aggressor. Tricky thing with Domestic Violence is this, both can be arrested but as practice we take the dominate aggressor and list the other in our reports. Of course there are obvious cases where one party is just beating the shit out of the other and there is only one committing a crime. That is not always the case.
Here, both engaged all though at first look it appears White's actions were reactionary only. He has a right to defend himself, just like you, me, and anybody else reading this. He does not have the right to go curb stomp her over a slap... I'm pretty positive you already get the point and understand that.
So with what we know in this case, if anyone of the two would be going to jail, it would be her.
So much more to these things than I could post on here but really don't see the point. Let's just keep it simple and say the best option is always to walk away if you can.
