Someone posted the comment below. Not sure how true it is but if it’s true, why was the jury not allowed to see the video?

“The guy was a Pest Exterminator who traveled 3 times a month for work. His pellet guns are in a hard case and he always takes them to his room so they are not stolen from his truck. he met a man and woman and they were having drinks in his room. The Guy asked about the case thought it was a guitar so he took out the pellet gun which also has a scope. They were at the door near the balcony upstairs. A couple in the spa saw what they thought was a rifle with a scope. They told manager he called cops. This was the outcome. The other guy had gone back to his room to get his phone and cops arrived. Fucking disgrace the guy was unarmed and the pellet gun was back locked in its case when police searched the room. No drugs or excessive alcohol in autopsy. THE JURY WAS NOT PERMITTED TO SEE THE VIDEO AND IT WAS NOT ADMITTED INTO EVIDENCE.”

The common theme from the comments I’ve read is the cops had the scene under control the whole time. No excuse what so ever to unload 5 rounds from a .223 into dude who obviously was a bit confused with the instructions given to him.

I don’t hate cops and I’ve had more bad experiences with them than everyone on the board put together.
I don't hate anyone.

What sad with most of the videos we see the person is always trying to be a thug or a tough guy or trying to get the cop to shoot them. This poor guy was crying,scared,begging to be listen to and this cop was playing Simon Says trying to get him to fail. What i dont understand is from what i read there was 5 LEO on sceen why do the others always seem to stand by and let stuff like this happen and not step in and secure the situation?
I am 43 years old and have done my fair share of dumb stuff and I have never feared a LEO might kill me until a few years ago.

This shooter was using his own gun, with the words 'You're Fucked' engraved on it. This fact was not allowed into evidence in his trial.

Cop convicted just the other day. Not being a smart ass here at all. But if you can objectively watch the video again, do so. This time, turn off the audio and consider these facts; They were responding to a call of a man with a gun in a hotel room. They encounter him, give him numerous orders, and he is having a hard time following them. Notice how many times he puts his hands behind his back out of view of the officers in front of him. As he starts crawling towards them he reaches back for who knows what reason. Legally, COPS DO NOT have to be shot at before shooting.

I don't expect everyone to understand or even except it. But when you are the one standing on that line, facing that scenario, a person acting in that manner reaching repeatedly after being ordered not to is a threat. That is how this was called justified.

But before you lose your shit... I personally think even though it might barely meet that requirement, it is a BAD SHOOT. With that many people I would have proned him out, approached, and handcuffed. End of story and I've been in that situation numerous times.

This is one of those that will be brought up over and over again and is a huge negative towards anyone in law enforcment.

What the shooter was telling the guy to do was confusing and impossible to do.... 'put your hands straight up the air and crawl towards me' - how do you do that?
The guy's shorts started falling down and he ended up dead.
If he was trying to scare the the guy as a tactic - fair enough, but he better be dam sure he knows what he's doing and he didn't.

The shooter said if the guy didn't do exactly what he said.... he'd shoot him.
He gave him instructions that were extremely unclear (to me, they were impossible) - then he shot him, just like he said he's do in the first 15 seconds of the vid.
I think most people understand that cops don't need to be shot at to shoot someone..... but this shooter didn't know if this guy was even armed.

To me, this (above) and the engraving on his gun are damning as hell, as to the shooters state of mind..... but what do I know.

fwiw; if I get ever get into deep shit similar to what happened here --- I sure as fuck hope you're leading the swat team.

They had a "report" of him having a gun. They had not seen any gun at that point. Imagine if you were staying in a hotel room and I called saying I saw you with a gun. Dude was probably like WTF is going on and was trying to follow orders.

Kind of reminds me of Pulp Fiction....."say what again".

From what I've read, ex-military guys who have seen combat and then become LEO's are FAR more likely to de-escalate situations like this rather than start shooting.

I also read that the video was not allowed in court? That is crazy, I also understand they where there on a gun call but obviously the guy at this time did not not have a rifle on him and was not acting like a crazy man or a tough guy and not following orders. He was scared and fearful and showed this to the officer and was trying to do what he was told with someone screaming at him with a RIFLE at him. Simon says is a game that everyone fails in the right state of mind, this officer let his power go to his head.
Reports also showed that before what is shown on video the officer said mutilipe statements that included you want to die today. What we do see in the video is the 4th time the guy pulled up his pants, 2 other times he explained that to the officer.
Cops today have even a tougher job with media and cameras but I really don't believe it is more dangerous today than years ago........bad guys have been around since day one, when I was young in the neighborhood my fear of cops was getting yelled at rough up a little being put in the car and being taken home and dealing with my parents or worst case going to jail. I am 43 so I am not that old to be talking about the "good ole days " but now I don't respect law enforcement because I see most of them as young kids trying to be tough guys.......those same kids when I was young who acted this way where called gangs and not cops.

There's 3 sides to every story.
One side, the other side ..... and somewhere in middle, there's the truth.
Cameras everywhere make determining exactly where the 'truth' is a lot easier.

If there were no camera's in this case, how do you think this story would read?

I would like to agree with you 100% but there is always 3 sides to the story. But with this example I can not see I would have a different outlook. Our society in general is out of control and cops are just one group that falls into that. I know at 43 I do not have the right mentality to be in law enforcement and would be a disservice to the community and myself. I also believe that age and LIFE EXPERIENCE should be a requirement to be in law enforcement. They pull this kids into this job with good pay and benefits compared to years before when pay was not that good and I believe most had a passion to help people. I maybe wrong but as a normal citizen I fill the training for new law enforcement is more about traffic/revenue and to issue tickets. I know LEO have to protect themselves and be aware in every situation but the amount of deadly force now seems crazy, every time they say the suspect moved towards me or their hands I could not see so I feared for my life........so it is Justified. I have feared for my life many of times in the moment by people's actions,words,even weapons in hand and I have not killed anyone yet and hope not to. Words and threats out of anger or fear or a tone of someone's voice should not determe their life.

I played the video twice. Once without audio and once with audio and not watching the video. My opinion, which means absolutely nothing , that cop is a punk . His day will come. Karma.

I guess my point was not everything on camera is always in context with the situation at hand. It’s my opinion in this case, based on what I see on the camera the officer made a terrible mistake.

I guess what I’m sick of is when something like this happens it’s assumed that the officer is just bloodthirsty or racist or whatever. My guess would be that it’s just a split-second of poor judgment or possibly poor training.

When a cop does something good or heroic it rarely makes the National news.
When a cop fucks up like this it’s a story for days, months or even years in some cases.
It’s hard to change the narrative that cops are a bunch of fuck ups and racists when the news media only follows the shitty stories like this for days.

Sorry if my post is a little rambling, I just don’t articulate my thoughts well .

You have good and bad in pretty much all professions. In general I've had good luck with police. They like my libertarian view points most times. So much so I've never received a ticket, I "speed" and drive well over the posted limit. In general its RCMP policy to allow 10 kmh's over the limit here. They tend to target unsafe driving more then speeding. Most police here do the same. In my younger days, they even told me to join their police force, after giving me a warning, etc. What's the worst word in nuclear physics? Oooppps! Police can also make deadly mistakes. Give some leeway.

It's pretty hard to not assume something is up with this cop based on what I see/hear in the vid and what's engraved on the rifle he used to shoot the poor guy. It's also hard to believe that any PD would allow this.
Soldiers in the military at war do this, and anybody in the public too.... but a Peace Officer on the job ??

I didn’t think I was defending the guy, sorry if you took it that way. I was defending Law enforcement in general. I don’t think they’re all a bunch of pussies that got bullied in school or out of control animals .

As I said before I know nothing about this particular case other than what I’ve seen of the video. Engraving on the rifle is disturbing to say the least. I would like to know how this got through the department he works for. Looks like poor supervision and training with a little “kill em all and let God sort them out” mentality.

Your post was also the first I’ve seen of the engraving on the rifle. That seems over-the-top for a professional law-enforcement organization.

An unarmed Black man named Walter Scott was executed in South Carolina by a cop for running away from the cop; shot 5 times in the back out of 9 shot attempts and the cop planted evidence near his dead body AFTER the shooting, and yet it takes the federal Government to come in and charge this cop with civil rights violations to convict him because a majority White jury in the state trial simply REFUSED to convict him of anything. My second problem is the uniform excuse for law enforcement officers across the country after having shot and killed some unarmed person of ANY color, and it becomes clear that the shooting was at best questionable and at worst, unjustified: " He/she was reaching for something". To believe all these cops in all these shootings where they make this claim, you have to believe that ALL these victims, most of whom were of sound mind albeit perhaps experiencing emotional problems(maybe guns trained on them had at least a PART in that), and presumably were just as cognizant as most of US as to police on civilian shootings in this country, decided at SOME point during the confrontation to simply commit SUICIDE. Total negligence. I predict a huge settlement.

I cannot imagine the Jury not being allowed to see the officer's bodycam video, if that is true it's a sad state of justice in that court.
I'm pretty sure the only thing they were not allowed to see was the photo of the rifle. I haven't read that they did not see the video.

Let's say the guy did have a gun. Could he not do the same to the cop?

Are you serious? Because if you are, that's a great argument for the cop not waiting to be shot at before firing. Think about preaching or asking for that to be standard practice for a minute before you support it.

I had not heard this, but I'm really not surprised. COPS do not get the passes most people think we do. You just don't hear about it all the time.

Many things are not used in a trial for various reasons. Prior to picking a jury, both sides argue what things can be used during the trial and presented to the jury. These arguments from the prosecution and defense are ruled on by the trial judge. My educated guess and its only a guess, is that the defense attorney argued that the engraved phrase on the rifle was too predjudicile to the defendant.

Everyone who plays cop, attorney, judge and juror on the internet needs to keep A few general things in mind. The criminal justice system is complicated. Most folks are conditioned incorrectly by movies and TV. Juries can be completly whack. Prosecutors sometime over charge defendants making it difficult for a jury to convict on the most serious charge(s) or any chsrges for that matter. Remeber that the burden of proof falls on the prosecution and the standard for guilt is, “beyond a reasonable doubt.” It is a very tough standard and it should be. By law and affirmed many times by the US Supreme Court, when using force including deadly force in the performance of their duties, cops are judged on an onjevtive reasonablness standard. In short, they are judged on what they knew and felt at the moment force was used. They are allowed to consider everything including training and experience. There is plenty more detail but it's late and it would be lengthy so Ill try and cut to the chase. When policebuse any type of force AND its caught on video, its never pretty. But that video will usually only be a portion of the story. Many things can come into play for and against the cop. This incident that is being discussed is not easy to watch. There are training issues tactical issues and some prosecutor thought there was enough evidence to bring criminal charges. A criminal jury saw and heard the evidence and thought differently. That standard - beyond a reasonable doubt, is tough to crack in this situation, especially if they charged him with murder. I will ho out on a limb and say that a civil jury will almost certainly see things diffetently unless the city settles first. The burdeon of proof in a civil action is a “perponderance of the evidence.” 51%. It is a much easier standard to reach.

I am reading through these comments, and everyone I have seen thus far expresses the narrative of an absolutely unnecessary, if not unlawful, shooting. I totally agree with that narrative. A fully armed, kevlar equipped cop with an AR trained on the back of a man cowering on the ground and begging for his LIFE has more options than to fire 5 rounds through him because according to the cop who killed him, he "reached for something". I have yet to SEE a comment saying that this cop did the right thing. Having said that, my problem is twofold: One, the simple fact is that had the victim in this case been BLACK, I can guarantee you that at least HALF of the comments on here would be in SUPPORT of the cop. AT least HALF of the comments here would be from people bending over backwards to BLAME the victim, and this kind of selective outrage has to STOP. It cannot be okay for something like this to happen to one person but not another under similar circumstances depending on the color of one's SKIN. An unarmed Black man named Walter Scott was executed in South Carolina by a cop for running away from the cop; shot 5 times in the back out of 9 shot attempts and the cop planted evidence near his dead body AFTER the shooting, and yet it takes the federal Government to come in and charge this cop with civil rights violations to convict him because a majority White jury in the state trial simply REFUSED to convict him of anything. My second problem is the uniform excuse for law enforcement officers across the country after having shot and killed some unarmed person of ANY color, and it becomes clear that the shooting was at best questionable and at worst, unjustified: " He/she was reaching for something". To believe all these cops in all these shootings where they make this claim, you have to believe that ALL these victims, most of whom were of sound mind albeit perhaps experiencing emotional problems(maybe guns trained on them had at least a PART in that), and presumably were just as cognizant as most of US as to police on civilian shootings in this country, decided at SOME point during the confrontation to simply commit SUICIDE. We would have to believe that ALL of these people decided to INTENTIONALLY act in a way that would give a cop, or COPS, a reason to fear for their lives. I tend NOT to believe that all of these people decided to commit suicide by cop. In fact, this "He/she reached for something" catch-all sounds suspiciously like the "State secrets" catch-all used by Governments who simply refuse to release information which the American public has every right to. Either way, I believe that certain methods need to be implementing to stop these shootings of unarmed, non threatening civilians by law enforcement in this country, and they need to be implemented sooner than later before civilians implement a pattern of retaliation against law enforcement for these killings.

This is the exact reason Colin Kaepernick started taking a knee...

I usually read your posts, and roll my eyes. It almost feels like you just want to stir the pot, for some end game in your mind.

At times, you seem like an intelligent guy, and I respect your service, BUT, this post is so ridiculous that it completely negates any point you have ever tried to make.

Last time I checked, your hotel room or your campsite is the same as your domicile, so the report of a man with a gun should not really be that big of a deal.

If the report was that he had a rifle, it's pretty f****** obvious that he didn't have a rifle when he was in the hallway.

The shooter was an egomaniac, Hot Head, prick. If he really had that bullshit engraved on his gun, then he should go down like a rock in the river.

With the amount of s*** that that cop talked, he really couldn't just prone the guy out and take control the situation?

He expressed his intent to kill him from the beginning. He told him that if he drops his hands down, he will shoot him. Then he tells him to crawl towards him. Then he shoots him. If anybody without a badge was in this situation, there wouldn't even be a trial, they would be guilty and done.

After Las Vegas, I think a man brandishing a rifle out the window of a hotel room may have added to the stress levels here.

I do not know if he was actually brandishing the gun out the window, what I heard was that people from the pool area saw a man with a gun through the hotel window or something like that.

This happen 2 years ago. I do agree if I saw someone with a rifle in a hotel window I would be a little nervous after Las Vegas but I would have been before also. But this guy obviously did not have a rifle on his body and that does not mean he is armed with more weapons just because he has a rifle in his room, he did not threatened anyone with the rifle before the police where on scene and he was in shorts on the ground out of his room in a hallway and had nowhere to run. Just because someone sees something or thinks they see something and the police arrive and there is no other signs that point to someone being a threat should someone be treated the way this man was in his last minutes of his life. This cop will have to deal with this the rest of his life and in today age it will not been to easy because you can not just leave and start life over where people dont know who you are. Funny how man countries cops do not carry guns and do a great job taking criminals into custody?

The Incident...
In summary: Suspect, has a gun. Contact suspect and direct him to keep his hands in plain view away from waist and back area. Suspect continues to reach towards his back and gets shot.
Comment: Not actually seeing a weapon makes this case "Dicey" for sure.

Percentage of bad cops...
Having worked with local and Fedearal officers in the Sacramento area, I have run into a few rogue cops but not many.

Percentage of racially motivated cops...
On a very rare occasion I have heard a racial slur. I have personally never seen cops, in Sacramento, state their intentions to target a specific race of people.

Conclusions: Being a Cop is not always easy, it can get real serious very fast. Cops might be handing out toys at the beginning of a shift and making a life or death decision later in the same day. Rogue cops have a way of weeding themselves out, have seen a few get fired & locked up for illegal activity, good riddance. Unfortunately, we have bad characters in all professions including but limited to: Doctors, Dentists, Lawyers, Teachers, and of course Politicians. These are only my observations and experience from my little corner of the world.
