Florida does have the “Stand Your Ground”/“Castle Doctrine” law. I believe it allows you to use whatever force you deem necessary to stop a person you feel has entered illegally and is an imminent threat to you. Or something like that. Wonder if this situation would come under that FL law? Brock Horner is lucky he didn’t get blown away by a victim who was rightfully fearing for their own life/safety. When was the incident reported to authorities? Any drug/alcohol testing for Horner and when?

The sportfishing community can be a very tight group which tends to ’care’ for their own. It wouldn’t surprise me if Brock Horner ends up getting the shit beat out of him by another within his local group. The guy’s a proven puke and bad for business. Is Horner a Captain? Likely he only has a CG 6 pack license. Officially, the “Operator of Inspected Passenger Vessels” authorized to carry no more than 6 persons for hire (OUPV).

IMO - Bottom line, Brock Horner may need professional help. And I’m not talking about a F’n attorney, before he gets himself or somebody else severely injured (at best). Curious if his prior problems at college were before or after his proclaimed service in the Rangers?

I would imagine many of the local guides aren't complaining too much. This guy will likely be out of business and will no longer be guiding in South Florida. Others will pick up his clients if they're of a different cloth. They surely won't complain about the business. But, I'll say this. These other Captains need to step up their game and prove to the incoming clients that they're not like this douchebag. Shouldn't be hard to do.....

A couple of actual boating items involved in this totally asinine incident. Speed - As previously mentioned, It appears FL does limit you to No Wake, slow speed within 300 ft when approaching and/or passing under bridges with less than 25 ft vertical clearance. Lights - if drifting while fishing you’re required to display the lights for a vessel of your size when underway. If anchored or moored, then the proper light(s) for your size. But, if tied up to the bridge structure? I believe it would be the same as tied to a dock - no lights required? But, I’d still want a flashlight to illuminate my own when other vessels are approaching.

I found it interesting he was charged with burglary. That charge shifts the castle doctrine into high gear, allowing the claimant unlimited deadly force options if he believes a "forcible felony" is occurring or may be about to occur.

In Florida, the Stand Your Ground law, an expansion of the Castle Doctrine, allows individuals to use deadly force in self-defense, including when facing a burglary, without a duty to retreat, if they reasonably believe it's necessary to prevent death, great bodily harm, or a forcible felony.

Castle Doctrine:

This principle, rooted in the idea that a person's home is their sanctuary, allows individuals to use force, including deadly force, to protect themselves against intruders or threats within their homes.

Stand Your Ground Law:

No Duty to Retreat:

Forcible Felony:

A forcible felony is a crime that involves the use or threat of force, such as robbery, kidnapping, or aggravated assault.


Presumption of Fear:

Florida Statute 776.013(4) states that a person who unlawfully and by force enters or attempts to enter a person's dwelling, residence, or occupied vehicle is presumed to be doing so with the intent to commit an unlawful act involving force or violence.

I wont name the Captain or the boat out of H & M Landing in San Diego…

Many, many, many year agos… I had dropped achor off La Jolla, 3 of us on my 27’ World Cat, and we where doing very very good, slaying the rock fish… with the occasional Yellowtail to 25 lbs.. literally on anchor for about 1hour or more… These are ###s that I learned being a deck hand on 6 pack boats (Lydian Lee & Patriot) out of H & M Landing.. SO I AM FUCKING CONNECTED… everybody in the fleet knows me… Because I was literally installing all the electronics on all the boats for several years, and being a deck hand.

Said Sport fishing captain, (1/2 day boat) literally pulls right fucking next to me… So I get on Channel 16.. Call him out on it, and he gets stupid…Go on Channel 72… call his dumb ass out again…

I tied on 9 oz of Iron…. on a Avet with 9 ft custom made rod (yes I made it)….

I literally start knocking the shit out of the side of his boat, about 6 times… I get on channel 16… mfker if your in casting range, your to fucking close… I am literally calling him out by name and the boat… and I do the same thing on channel 72….

Start casting again…. Whack whack whack whack whack… paint/fiber glass is flying… because thats big fucking treble hook.

About the 18th hit to side of his boat with 9 oz out fucking iron… he fucking moved….

Then the dumb ass had balls to call me out… after all of the captains in fleet came down on him hard…That did not end well for him… he went down after the second hit…

If Captain dumb ass was stupid enough to try and get on my boat… That fucker would have taken a flying gaff to the gut, before I put the engine in gear…

MFKR wants to get stupid on the water… I will show them the definition of stupid.

There are ass hats in all walks of life, and that includes sportfishing captains. When I was operating 65 - 100 ft passenger carrying sport boats, some other sportboats would move in on us. F’n idiots. We all knew who they were. No talent and no common sense is a bad combination.

2. Don't let anyone get on your boat. He should have put it in gear and slammed open the throttle as sons as the guy stepped on the gunnel.
3. Should have dialed 911 as soon as he was boarded.
4. Keep the above shown flair gun at the ready at all times.

I'm also concerned about how this guy supposedly is on 100% VA disability but can run a fish boat 300 days a year. And allegedly injured in combat yet was a desk jockey.
