I’m really surprised people think they should be able to hunt and fish and not expect a game warden to make contact with you if they see you. Of course they are going to make contact. Thats their job. They also want to educate you on the rules before you make a mistake.

Vessel Searches.—Not only is the warrant requirement inapplicable to brief stops of vessels, but also none of the safeguards applicable to stops of automobiles on less than probable cause are necessary predicates to stops of vessels. In United States v. Villamonte-Marquez,311 the Court upheld a random stop and boarding of a vessel by customs agents, lacking any suspicion of wrongdoing, for purpose of inspecting documentation. The boarding was authorized by statute derived from an act of the First Congress,312 and hence had “an impressive historical pedigree” carrying with it a presumption of constitutionality. Moreover, “important factual differences between vessels located in waters offering ready access to the open sea and automobiles on principal thoroughfares in the border area” justify application of a less restrictive rule for vessel searches. The reason why random stops of vehicles have been held impermissible under the Fourth Amendment, the Court explained, is that stops at fixed checkpoints or roadblocks are both feasible and less subject to abuse of discretion by authorities. “But no reasonable claim can be made that permanent checkpoints would be practical on waters such as these where vessels can move in any direction at any time and need not follow established ‘avenues’ as automobiles must do.”313 Because there is a “substantial” governmental interest in enforcing documentation laws, “especially in waters where the need to deter or apprehend smugglers is great,” the Court found the “limited” but not “minimal” intrusion occasioned by boarding for documentation inspection to be reasonable.314 Dissenting Justice Brennan argued that the Court for the first time was approving “a completely random seizure and detention of persons and an entry onto private, noncommercial premises by police officers, without any limitations whatever on the officers’ discretion or any safeguards against abuse.”315

Then it’s settled. Drop a line with a 9 year old that wont catch a guppie and you are a buffalo hunter in need of hunting warden to police. Drop a boat in the water and you are needing the coast guard to inspect your vessel documentation.

I just want to go on vacation and not be forced to demonstrate that I’m not a criminal.

Y.A.H., you are correct Sir. The title referred to Arizona State Patrol and that was who I was contacted by. I believe someone else stated they were essentially the same as game wardens. I dont know. Sorry for any confusion.

As far as what you could try when you do get stopped..... Ask them what their probable cause is and the reason for the stop. Then explain how you are in a public place, but demand they respect your privacy because you say so. And before they board your vessel, demand they provide you with a copy of a search warrant signed by a judge. If that doesn't work, try my method.

to ensure public safety on state waterways, to screen for

watercraft activities.
B. An individual may be required to perform the following during
a watercraft stop
or at a watercraft checkpoint:
1. Stop or halt as directed when being hailed by a peace officer
or entering the established checkpoint boundary as
prescribed under A.R.S. § 5-391,
and
2. Provide evidence of required safety equipment and registration
documentation prescribed under A.R.S. Title 5,
Chapter 3, Boating and Water Sports.

C. This Section does not limit any state peace officer's authority
to conduct routine watercraft patrol efforts prescribed under
A.R.S. Title 5, Chapter 3, Boating and Water Sports.

Same thing. Arizona Game and Fish IS State Patrol. Note the insignia between "State" and "Patrol in the photo, above. They decided to use the "State Patrol" verbiage on their boats and vehicles, as there is no question as to their authority, and it's shorter than "Game and Fish Patrol". A lot of people (some here, apparently) don't think that Game and Fish Officers/ Game Wardens / Game Rangers, are "real" police. I can't speak for every other state, but here in AZ they are full authority Peace Officers, attending the same academies and same curriculum as every other City Police/Sheriff's Deputy/State Trooper/Town Marshall, etc. And after they are done with the basic academy, they go through an additional 6+ weeks of advanced training for the Boating and 3F* factors.

Speaking of the 4th Amendment, here is the deciding Supreme Court ruling on Vessel Searches. While this ruling applies to Federal Waters, (which the Colorado River is), Several state Supreme Courts have upheld the provisions of this decision on sole state waters. (lakes entirely within a single state)

I always have a current CA fishing license and it's valid on the river. I'm not 100% sure that I would be legal fishing from shore on the AZ side though. I didn't ask as it usually doesn't apply to me. You'd have to ask someone a LOT smarter than me. :D
Pretty sure it's in the water in boat tube kayak etc either az or ca but on shore its the state your standing on. So if on az side don't quite Beach the boat fish from it or sit on a floatie.

Correct. If feet or boat on land (wet/dry, beached), or boat tied to shore, you have to have that state's license. Free floating on the surface, you can have either one.

Also be sure you know where the Reservation line is. You'll need to have a Tribal Fishing license, also.

But I will have the argument with people that consider themselves conservatives such as myself. It’s actually weak conservatives that will be responsible for losing the country bite by tasty bite. What are you conserving if you can’t go float around in a piss pond on vacation without having to prove yourself to law enforcement that you are not criminal. It’s a not an anti cop position...it’s conservatives are weaker than puppy piss and govt likes the revenue argument. Make sense?

And for the record. Aside from checkpoints (I was only involved in one, during a 40 year career), I never had to use "random check" as justification for a stop*. There are too many idiots doing too many stupid things to waste time on someone who is (apparently) going about his business in a safe, legal way. I could find probable cause on probably 2/3 of the boats owned by members of this forum. You know those fancy custom, scrolled registration numbers? Illegal. Or those blue numbers on purple hulls? Illegal. Or the fade numbers that partially match the hull color? Illegal. How about the placement of the annual decal? Which side of the number is it on? Yeah. They are "bullshit" reasons, but start crying about "probable cause" and they'll find your probable cause. I made a major (several hundred pounds) dope bust on Lake Havasu (they were taking it from Havasu Landing to LHC by boat, due to increased patrols on I-40) based on the registration numbers being jammed together, rather than properly spaced. I really didn't need it (especially since I was operating under the Coast Guard banner) but it's always better to have a sure thing, rather than leave something like that to some idiot liberal judge.

*The only "random" stops I made was while operating along the Mexican Border, from San Diego, out 200 miles, where we boarded nearly everything coming north. But since we were boarding everything, even that wasn't "random", but more of a Border Check.

Evidently you can, and just let the kid poke holes in his fingers with the hook and smack the fish against the rocks to get if off the hook rather than Dad helping perform a nice gentle release because Dad didn't want to buy a CA license and a Tribal license for the 2 or 3 weekends the kid might have the opportunity to catch and throw back a 6 inch long fish off the dock. Rules is rules...and while I have it in my mind that no halfway sane F&G officer would cite me for helping my kid have a bit of fun at the river, I'm not ready to drive 5 hours back to wherever I need to drive for a court hearing, so now there will be no more fishing...or a lot more dead fish on the rocks...since that's perfectly legal without a license for a 9yo while dad sits safely 20 feet away with a beer, since technically, it is a release and nobody is "taking" undersized fish.

Laws are tough, because they have to be made to take into consideration every possible situation...which requires that they be written throw a much larger net than necessary, and take into acct. the fact that LEO have their own brain and the ability to be reasonable in their decision to cite or not cite...and while most are, some are not, and that causes problems.

Maybe take a look back at how we got to where we are today....


Back in the 20's and 30's fishing and hunting were taken for granted. Folks used to take ALL they could and damned near killed off the deer, fish, elk, etc....


The rules were put into place by folks interested in CONSERVATION..... Folks that were interested in ensuring that generations into the future that some kid in 2198 could actually CATCH a fish..
It isnt about YOUR rights, it's about the kids your great grand kids haven't had yet....



Its about the future generations being able to enjoy it...

As with everything in life, there must be compromise to some extent. There will always be a battle about to what extent that compromise should occur.

Do I think things need to change with the times....yes, to some extent...again, to which is extent is debatable. Do I think the basic principles of the constitution should remain...absolutely, but how those basic principles are defined are again..up for some level of debate as times change.

Correct. If feet or boat on land (wet/dry, beached), or boat tied to shore, you have to have that state's license. Free floating on the surface, you can have either one.

Also be sure you know where the Reservation line is. You'll need to have a Tribal Fishing license, also.
Okay so I did some more research on this today. California and Arizona have entered into a reciprocal acceptance of the other states license for fishing the Colorado River from either shore.
Fish from the Arizona shore, with a California license, and comply to California rules. And vice versa.
Does the tribal issue mean I can't fish from the blue water without a tribal license?

You seem like a reasonable guy. I just think that it gets used against us in small doses until the intent is completely side stepped. We’re discussing basic privacy while boating. In other national news we are watching roe v wade work itself into post birth abortion. I can like cops, obey the rules, and not like to be randomly investigated right? Headless showed it’s because fuctards mess it up for all right? Like in a Marxist premise of greater good? Greater good is opposite of individual sovereignty. Opposite. Not conserving it. Not a good compromise because you will be compromised over and over until you don’t have it. And I want to say it while I still can....that’s a thing too right now.

I think that you are taking this to a completely unnecessary extreme. You can expect a reasonable amount of privacy, but in any public setting, where the public are expected to abide by laws, there will be law enforcement personnel making sure that happens. If you're not fucking up, it's a non issue generally. If you are fucking up, LE is there to protect the rest of the public from you....and vice versa.

Be reasonable. If everyone would be reasonable, this country would be a better place.

Edit: And I agree 100% with you on the theory of death by 1000 small cuts....goes back to everyone being reasonable.

Isn't it my right as a citizen of this country to have a safe place to live without worrying about my house getting broken into or my car or truck getting broken into at night? A neighbor a few blocks down saw some asshole checking out cars walking up the street a few nights ago, then saw him open a car and sit down in it, proceeded to call the cops, who showed up...talked to the guy for a few minutes, but because he didn't have anything in his hands and hadn't yet stolen anything, let him walk free...there was "insufficient evidence" to arrest him for any wrongdoing. The car was unlocked.

The above situation is the society you describe...where there is a reaction based enforcement of laws.

The society I want, is a proactive enforcement...where shady motherfuckers get reported, or even random motherfuckers get checked out quickly and found to be not shady motherfuckers...but some will be confirmed as shady motherfuckers, and get locked up or fined or whatever to deter them from continuing to be shady motherfuckers and robbing me in which case I'll put some lead in 'em and spend the rest of my life in prison for murder, leaving my wife and kid on their own.

Which is a better scenario in your mind...a bit of LEO checking up on things or a complete shitshow? I'll take the first one.

I’m completely on your side on this one. Headless is in the wrong imo. I agree as to why you have to prove your compliance with the laws. It’s like boaters are idiots and don’t know the laws of the water.

For me I have been boating since I was 6 months old. So 33 years. I have been driving a boat solo since I was 12. So 21 years. I’m pretty sure I know the laws and don’t need to be educated on them with a random stop. It’s all bullshit for contacts which justifies more enforcement and round and round we go.

Perhaps if I had a 450 outboard I would be ok ;)
