As the title states, looks like I need to retain an accident attorney for the accident my son was involved in. Any members here know of a good attorney in the SoCal area?
Spoke with my State Farm agent as well as my claims agent regarding this BS claim, and at this point, I feel it would be best to retain an attorney.

I have no personal experience with this attorney. short story I was in an accident about five years ago and rear ended and a girl was decapitated in the back of my trailer. I was marked 0% at fault but of course the family came after me. This is the first Attorney, the family retained, and my attorney told me that they are the absolute best. I was very stressed out, even though it wasn’t my fault. As soon as the police report came out, this attorney dropped it and he told me if they drop it you have absolutely nothing to worry about from anybody else. Nine attorneys later and four years it finally closed with the family losing. It was very drawn out and still a very stressful experience.

So that is all I know about that Attorney, but what I was told they are spectacular..

I think most are the absolute scum of the Earth. I’m sure there is a couple decent ones somewhere but I have never met one.

We had one a few years ago when we were with State Farm. State Farm wanted to disclose to the plaintiff our plan limits but needed our approval. I told them no way in hell cause I knew they just wanted that info so they could make the suit less than the limits to encourage State Farm to just settle. It was a total BS suit too. my wife tapped a Mustang at a Stop light with the Mustang didnt go on the green. The cop that took the report actually noted on the report there was no visible sign of damage on either vehicle, but the Mustang bitch tried to claim physical damages after the fact.

Never heard anything else about it after that.

I'm in SoCal and had a good experience with Sweet James for my wife's accident. They handled everything.

Did your insurance company tell you to hire an attorney? Seems premature.........

We released our claim limits in hopes that SF would pay, and we would be done with this. The other party's attorney wants my bank account numbers and balances along with information on any other assets that I may have.
Time for me to obtain an attorney!

Yes, they expected me to just be okay with providing all of my personal asset information to the other party's attorney. When I told them that isn't going to be provided, they recommended that I talk to an attorney.

They are probably probing to see how much they can easily get out of you. They likely have a target percentage of liquid assets that they will ask for in hopes that you will just settle to make it go away.

Unless the other party was seriously injured, I would say this is all a fishing expedition by the other attorney (in my non-professional opinion) to see what they can get. The fact that they were able to get the insurance info from you already makes me think they have you panicked and are swinging for the fences.

No, no and fuck no. Do not give them anything else. Do not take their phone calls, and do not respond to any letters they may send. This is typical injury attorney shit. If you make it easy for them and provide the information, they will walk all over you. Ignore them and just deal with your insurance company, they should be providing an attorney for you/your son.

Just another thought. Your insurance company is not on your side. They want to limit their liability.

How old is your son?

This. I had the attorneys trying to probe the fuck out of me from my whole deal and got letters all the time, and I never responded to anything at all and let the insurance company deal with everything. I wouldn’t even give a statement to the insurance company after the accident I told the insurance company that they can look at the police report when it comes out because all the information is there. It’s all stressful, but from the sounds of it, you have nothing to worry about.

If you are not ordered to do so by a judge why would you even consider it?

I would wait for the day I am called into an actual courthouse before doing ANYTHING more.

IF and or WHEN you are ORDERED to give this POS "info" by an actual JUDGE in a LAWSUIT...... until then, DO NOTHING!!

(this is the shitty free advice you get on the internet, take it for value paid)

Just let State Farm handle it, do not correspond directly with that ambulance chaser AT ALL. I’ve been in a few of these.

I have only delt with my insurance. My claims agent is who recommended I review the demand letter with "my" attorney. When I spoke to him last week, I told him to assign an attorney to this claim because I have no intentions of providing my bank account number to anyone.

There are lots of personal injury attorneys on the plaintiff's side working on their own but a large majority doing defense, do it for the insurance companies.

Always have to be careful because some general civil litigation attorneys might claim that they can defend anything without having much personal injury experience.

I've chimed in on the other thread. Plaintiff's attorney looks to be a solo with some staff. Accident was allegedly low impact. The claims only really have major value with low impact if you hit someone who had some fragile pre-existing issue/recent surgery. Usually, attorneys just request a signed statement saying that you weren't in the scope of employment and you had no additional insurance when accident occurred.

Most attorneys won't go on a wild goose chase to figure out assets if the claim isn't worth much more than the policy limit amount that the insurance has offered.

Thank you again Tooms22.

I seriously don't see how this would go past the insurance limits. Having my insurance recommend I retain an attorney got me a bit fired up here. Definitely eye opening.

My Tacoma got smacked this morning while parked by some old lady who spilled her coffee coming around the corner....pushed another car into mine. I'm contemplating scraping the thing vs dealing with insurance and body shops. I hate it. I hate them. This is why previously, I never had nice things.

I hope your situation ends up working out....but I wouldn't count on it. Insurance companies are the devil, and so are most attorneys...just need to find the bigger evil and hire them.

Your insurance is worried about a bad faith lawsuit.

Your insurance doesn't provide everything the plaintiff's attorney requests. Plaintiff's attorney says this is an obvious policy limit case and my requests are reasonable. Your adjuster doesn't provide all of it.

Plaintiff's attorney proceeds to file case, gets a verdict above the policy limit, normally you would cover that amount, but because your insurance didn't provide everything requested - the attorney alleges that your insurance acted in bad faith, they go after your insurance for bad faith and your insurance pays the difference between policy limit and actual verdict.

The only problem here is that you're saying that you won't provide everything. Your insurance is saying yeah yeah provide everything they asked for. Your insurance company is looking out for themselves when they tell you to get an attorney. They don't care about you.

I would recommend admins removal of this thread personally if I were you
This, kinda

You have definitely given plenty of info in here so far, do not give anymore on here. Sweet James office may be able to recommend a good defense attorney for you, just give them a call and explain what you are looking for.

Looks like there are gender issues.

Watch out. He’s an attorney. He can sue you for that without any hourly expense to himself.

One reason I’m not a dab of financing for attorneys. I’ve had a couple fun ones.

Increased liability limits are inexpensive. Everyone should look into increasing their limits especially if you have kids. Umbrella policy for everything.

Also, just because they ask for bank records does not mean they have access to them. If they want banking records, they would need to subpoena them, which would require that a civil case was actually filed, and even then you would receive a "Notice to Consumer" giving you an opportunity to object to their request before the info is released.

Until things blow over, you could always deplete the accounts, stuff the money into t new accounts opened by the spouse, and leave a few thousand in the old accounts to pay bills. Then you could comply with their request, providing them with the "old" account info.

As far as other asset info like real property (real estate) - that's easy to find via databases like Lexis/Nexis, or even online for free. I'm sure that's what they pulled on you. It's all public records stuff, anyways.

PSA - that's why everybody needs to "opt out" of these people finder sites. The info they collect about you, and sell to anybody who's willing to pay, is staggering. There are services that will opt you out which are very effective. You can also opt out yourself, it just takes time to do so.

This seems like it would be good information to share with the class.

google "results about you" has been doing it for me (free), I get notifications about results found and then they review and remove as they see fit? works ok.

IF you have a google account (gmail etc)

click on "settings" add your name, address(s), phone number(s) and google does the rest.

I have recently been contemplating this. I don’t have much but want to keep it.
Add through my AAA?

That or through your homeowners as an umbrella policy to cover liability on everything. Cars, house, boat etc.
A friend's daughter was in an accident years ago. His daughter was driving and one of the occupants, a young girl, died. A real tragedy. Settlement was $4 million. He had a high number liability policy that covered it.
He took all of his kids over the age of 18 off his policy and had them on their own policies.
