So a buddy of mine got busted for a DUI on a golf cart... Anyone have any advise???

In Arizona..... he has California drivers license which he never gave them.... just his Arizona ID card..... has anyone been threw this?????

He needs a lawyer although I am not sure how to put an interlock device on a golf cart. Arizona gives out DUI's on any motorized vehicle. Had a friend get one in college riding a mini bike (old school minibike with lawnmower engine and metal plate on rear tire for brake) down back alleys home.

Arizona LE has no sense of humor when it comes to this.

What did he blow. If he is over .15% then I wouldn't even bother getting a lawyer. Just plead with the DA....

If he is under .15%, he can get a good lawyer and possibly try to get it dropped to a wet reckless on his record....

Either way it is fucked

If you are an Arizona resident and you refuse to blow or to give a blood sample, your Arizona license is automatically suspended. Interesting question as to whether or not that would affect your california drivers license. If he blew or gave a blood sample, depending upon the result, he might have a slim chance if it was under .08.

He needs a lawyer who probably practices in AZ and CA. In either event, his insurance does not care where he received the DUI.

He has commercial license in California..... does it get suspended for a year??? Or will they restrict it????

Yep, he's hosed. Ca will pick up the DUI. Their one of the states that picks up any driving violation you are written.

i have had several moving violationsin az, not a dui but driving un a suspended cdl and Cal never picked them up.... if you pull my CDL theres nothing on it from the az

So do you not get a DUI on your record? Or do you just have to get your license re instated ?

lawyer up, MAYBE can get reduced to wet wreckless if you're lucky... but with a BAC that high you might as well just bend over. id suggest enrolling in AA asap so the judge thinks kindly of you before you go and show up to court with a bag full of nothing. its in his hands now.

Had a friend get on on a Motorized Cooler,, blew .10. Same penalty if he was driving down the freeway.

I dont mean get off like get out of it but maybe it wont roll over to ca cause the ticket was written under an az ID card number. Maybe a good lawyer can fight this and win. Idk

My story involved a DUI when I was 17, except I wasn't DUI!! Once the blood & piss test came back negative the DA dropped my charges. Still had to fight with DMV to reinstate my license (they kept postponing my DMV court hearing).

Wasn't until I won the lawsuit with the city police did they mellow out and the DMV still drug their feet reinstating it.

My guess is that if it went down the way it was presented he stands a good chance of getting off in a technicality. I would lawyer up instantly with an AZ lawyer.

I don't even take a sip and drive a bike with my commercial license. Its damn near as precious as your credit score these days.

Technicality is prob a bad choice of words. There might be something here with the az vs ca DL thing. He should pay the price for sure but if he can save his ca cdl then its totally worth the argument imo.

I don't know the law in AZ and no way am I disagreeing with you.

From a common sense standpoint he's screwed. Not arguing that.

Just don't know what the law is. Now days people can get out of prison time because Miranda Rights weren't read. Its not right but it does happen.

I would like to hear where this goes... Either way this is a hard lesson.

I've gotten one...and got out of it. Hopefully it was on private land or Indian land, makes it a bit easier. Also it depends on the agency that picked you up too. Like anything else it took time off of work and driving to the river once a month but where there is a will there is a way.

Matt and I just won a jury trial in Havasu for Extreme OUI with a full acquittal on all charges. I had a really good case ( to be told in another thread sometime) but he was instrumental in getting that case through the system and heard by the jury...

The AZ DUI machine is not a good place and there is no getting on the good side of the judge. You are definitely guilty until you prove yourself innocent...

I thought it was .04 only when driving a commercial vehicle.
I know no traffic school for infractions with class A but I get conflicting answers when asking about the DUI number and what vehicle is being driven.

Once you have a commercial its .04 always. The thought is that you're considered a professional driver always. Your held to a higher standard.

I was in a F150 pickup and was rear ended recently. When CHP was gathering each of our information he went straight to the drinking questions with me. He made sure I was aware of the law. Said he scrutinizes when dealing with a commercial driver regardless of the vehicle.

Funny thing is that I'm hardly ever in a commercial truck. Only use it when we're short drivers at work. Maybe a few times a year.

And your correct... No traffic school allowed even if the infraction is in a normal vehicle.

As well call Michael Frame in Parker.. Talk to them both, and see which one is willing to go the distance.. I'd fight it 100% tooth and nail, because if you plea you are fucked..

They come into ours and patrol, especially on Holiday Weekends.

Labor Day weekend, they popped a lady for DUI on a golf cart. She was a visitor to the park, not a resident. However, a male resident (whom I don't know) intervened, and he got arrested also for interfering.

In Arizona, you can receive a DUI on any private or public land with access to the public. So, in the mall parking lot which is private land open to the public or in the forest or at the dunes. You can however get drunk and drive on private land not open to the public. So, you can get drunk and ride your mini-bike in your backyard in circles.

I have clients that end up being charged for out of state tickets on there insurance all the time...including AZ

Typically takes a year or so to trickle down but I wouldn't count on it not showing up.

since 1999 i have had about 5 tickets a few that were never paid in AZ they have never shown up on my CDL or insurance only one of them i gave them my CDL

im sure now that the states are wanting money who knows what can happen

What did you give them when they asked for your lic?

I had a buddy that had an AZ id and ran his car off the road drunk. he gave them the AZ id and never responded and they had a warrant for him in AZ. When ever we got to AZ he would swap drivers becuse he said he would go to jail if they got him for something.
