Yes, it is very simple to access the public records.

Determining the married status of a couple can be tougher than it seems since the only people who know the truth are the couple themselves.
While it's true they may have went thru a marriage ceremony attended by family and friends, they also could have divorced for "business" purposes without anybody else knowing. Or, perhaps they were never married, but carry on like they are. I know of two acquaintances who completed fake (but real) divorces because it helped them in business transactions.
In California, marriage licenses are mostly confidential, but not for the reasons you think. Filing for a "confidential" license allows the couple to forego an otherwise required blood test. Thus, nearly all marriage licenses are confidential. Interestingly, you can find Las Vegas marriages online for free. In either case, a license does not always mean they were married, though.
Also, public records in California are getting harder to come by. In most instances, unless you are a spouse, parent, or immediate family member, almost all vital records are no longer available. California, like many other states, is moving towards becoming a closed records state due to identity theft concerns.
Tax records and tax filing status are usually the best indicator; but obviously are not readily available. Plus, the status of a marriage could change within a tax year. Not likely, but it can happen.
Also, insurance records of all sorts are usually a strong indicator, too. Sometimes tax liens shed light on sole proprietorship/dba type businesses.
Because all the situations discussed-above can change in short notice, a two-step approach is best.
First, you find an indicator they are married; second, you check to see if a dissolution action was filed to change that status.
For example, real property ownership and even bank accounts are "titled instruments"; how they are owned has legal bearing on a marriage in a community property state.
In this instance, you are looking for a deed or a trust deed where title is vested as "Husband and wife", or "Married as his/her separate property."
Then, you look for a divorce action. More importantly, you need to review the court docket to see if the divorce was finalized. If no final judgment/stipulated judgment can be found, then the marriage was not terminated. Sometimes people will file a petition only, just to deceive creditors. But, if no divorce filing is found, then it's a decent indicator they are still married.
As I said in my opening sentence, only the two parties themselves know the factual truth. All you can do is expire the available resources, and go with the best information you can find. If you enter into litigation, then later you will have legal tools (discovery and interrogatories) to determine the legal marriage status. But, you will have exhausted reasonable due diligence, instead of making a decision based on hearsay, or a guess.
The way this thread reads I thought it was a "What Happens In Vegas Doesn't Always Stay In Vegas" situation.
